VARIANCE SETBACK
Proposed Action
Staff recommends the following motion: Move to adopt Resolution RZ05 -11,
recommending approval of a setback variance, for the addition to Supervalu.
Overview
Supervalu is proposing to construct a 130,000-square-foot addition to the existing
building at 300 Second Avenue South. The proposed addition will be located on the east
side of the existing building. The existing parking on the east side of the building will
be relocated to the south side
The applicant has also applied for site plan approval and a height variance.

Primary Issues to Consider
What does the ordinance require?
The front yard setback for an industrial building is 20 feet.
What are the specifics of the applicant's request?
The applicant is requesting a setback variance of 10' 4 The northeast corner of
the building is 10' 6" from the property line. The southeast corner of the
building will be 23 feet from the property line
What is the staff recommendation?
Because staff is recommending denial of the site plan and the height variance, the
request for the setback variance can not be granted because there will not be a
project.
Alternatives
1. Recommend approval of the variance. By recommending approval of the variance,
the City Council will consider a recommendation of approval. If the Planning
Commission considers this alternative, findings of fact will have to be stated that
support this recommendation.
2. Recommend denial of the variance. By recommending denial of the variance, the
City Council will consider a recommendation of denial.
3. Continue for further information. If the Planning Commission indicates that further
information is needed, the item should be continued.

RESOLUTION NO: RZ05 -11
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
DENIAL OF A VARIANCE FOR A FRONT YARD SETBACK
WHEREAS, an application for Variance VN05 -3 has been made by Supervalu; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN05 -2 was made by Supervalu on
March 25, 2005;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
April 12, 2005: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered;
and
4. Legal description of the parcel is as follows:
Lot 1, Block 1, Supervalu Addition
NOW, THEREFORE, BE IT RESOLVED that application for Variance VN05 -3 is
hereby recommended for denial based on the following Findings of Fact:
1. That the site plan for the addition to the east is recommended for denial.
2. That the Planning Commission found no hardship was demonstrated for the
height variance for the south expansion and the same conditions exist with the
addition to the east.
3. That because the site plan and height variance are recommended for denial, the
east addition as proposed cannot be constructed.
Adopted this 12 day of April 2005.
