PROPOSED ACTION: Staff recommends adoption of the following
motion: The request by Paul Steiner to rezone 708 - 12th
Avenue South from B -3 Business to I -1 Industrial is
approved.
Adoption of this motion will allow Mr. Steiner to build
mini storage development.
OVERVIEW: Mr. Steiner is requesting rezoning the property at
708 12th Avenue South from B -3 Business to I -1 Industrial.
This rezoning will allow construction of a mini - storage.

ANALYSIS: The subject site is surrounded by I -1 zoning on
two sides and B -3 zoning on the other two sides. The change
of zoning for the subject site will be a continuation of the
I -1 zoning presently to the north and west. The B -3 zoning
will not be changed on the property between the subject site
and the Westbrooke Patio Homes. The vacant parcel to the
north of the patio homes will remain vacant because the
parcel was used in figuring the density of the patio homes.
This piece of property provides a 150 foot buffer.
The use of the parcel for an industrial use will be
compatible with the surrounding parcels. The site is
surrounded on two sides with business and industrial uses.
The residential area will not be affected because of the
buffer area between the property and the patio homes.
The Comprehensive Plan has designated this area as R -2,3.
This designation would not be practical in this area. The
site is surrounded by industrial and business zoned parcels.
At this time the Comprehensive Plan should also be changed
to industrial.
ALTERNATIVES:
1. Approve the zoning change from B -3 Business to
I -1 Industrial. This will allow the applicant
to construct the proposed mini- storage
development.
2. Deny the zoning change. The applicant will not
be able to construct the proposed mini- storage
facility.
3. Continue for further information. If the
Commission feels they need more information to
formulate a decision, this request should be
continued.
The following are suggested Findings of Fact and Conditions
should the Commission recommend approval:
1. That the zoning change from B -3 Business to I -1
Industrial is compatible with the surrounding
area.
2. That the subject lot meets the minimum lot
requirements for an I -1 District.

I am writing on behalf of the Westbrooke Patio Homeowners
Association in regard to the request for a building permit and
variance by Mr. Paul Steinar on property located at 7th street and
11th Ave. South in Hopkins. It is the consensus of the Westbrooke
Patio Homeowners Board that we support the concept of a mini—
storage facility such as the one planned by Mr. Steinar for that
site. It would appear to be compatible with the residential area
surrounding.
We do object to your plan to change the zoning to I -1 or industrial
zoning. This type of use is not compatible with the area. If the
zoning ordinance is silent on a particular use it my perception that
the ordinance may be amended rather than using the method of
spot zoning change to fit a requested use. It would seem that the
rental or sale of time for personal storage is not a warehousing
activity but rather a unique use which is emerging in the Twin
Cities area and should have some special attention in the
ordinance.
I would appreciate your favorable consideration of my comments
and request for change in the ordinance to include the personal
ministorage as a B -3 use. I would also reiterate that the set back
variance requested would meet with no objection from Westbrooke
Patio Homeowners at this time.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR REZONING ZN87 -3
WHEREAS, an application for rezoning entitled
ZN87 -3 has been made by Paul Steiner, to rezone the property
at 708 12th Avenue South from B -3 Business to I -1
Industrial.
WHEREAS, the procedural history of the application
is as follows:
1. That an application for Rezoning ZN87 -3 was
filed with the City of Hopkins on October 29,
1987.
2. That the Hopkins Planning Commission reviewed
such application on November 24, 1987.
3. That the Hopkins Planning Commission, pursuant
to published and mailed notices, held a public
hearing on November 24, 1987, continued to
December 29, 1987; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to ZN87 -3:
LY' That the zoning change from B -3 Business to I -1
Industrial is compatible with the surrounding
area.
That the subject lot meets the minimum lot
requirements for an I -1 District.
BE IT FURTHER RESOLVED, that application for
Rezoning ZN87 -3 is hereby approved subject to the following
Conditions:
That no variances are granted for the proposed
project.
That the Comprehensive Plan is changed from R-
2,3 to I -1 Industrial.

AN ORDINANCE AMENDING THAT PART OF
HOPKINS ZONING ORDINANCE 515 -570 PERTAINING
TO AND CHANGING THE ZONING
BE IT ORDAINED by the City Council of the City of
Hopkins as follows:
SECTION 1: That the present zoning classification
of B -3 upon the following described premises is hereby
repealed and in lieu thereof the said premises are hereby
zoned I -1:
PAR: The North 287.1 feet of the West 379.31
feet of the Northeast Quarter of the
Southwest Quarter of Section 25,
Township 117, Range 22, subject to
roadway easement.
according to the plat thereof on file or of record in the
office of the Register of Deeds in and for Hennepin County.
SECTION 2: That the presently existing Hopkins
Zoning Map adopted as part of the Hopkins Zoning Ordinance
515 -570 is hereby amended and changed in accordance with the
above provisions.
First read at a regular meeting of the City
Council of the City of Hopkins, held February 2, 1988, and
finally read, approved, adopted and ordered published at a
regular meeting held on the 16th day of February, 1988.
