Planning Report: CUP88 -
Staff recommends the following motion: That the application to amend
the original Conditional Use Permit to allow outside storage is
denied.
Denial of this motion will make the Auto Mall remove the fenced tire
When the Auto Mall was approved on February 3, 1987, one of the
conditions of the Conditional Use Permit was that there was to be only
inside storage of all materials maintained. During the construction
of the Auto Mali a fenced tire storage area was constructed behind the
Tire Pius store. The staff informed the Auto Mali that this was a
violation of their Conditional Use Permit. They have applied to have
1110 their Conditional Use Permit amended to allow outside storage.
Issues to Consider.
o Should the Auto Mall have outside storage?
o Is there another alternative to outside storage?
o Does Tires Plus need an additional tire storage area?
o Is a fenced storage area acceptable to screen outside
storage?

Detailed Background.
The Auto Mall constructed an outside storage area in violation of
their Conditional Use Permit. Since the construction of the fenced
tire storage area, the staff and the Auto Mall have been trying to
solve the tire storage problem.
The following are the alternatives the Auto Mall has:
1. Remove the fenced storage area.
2. Apply to amend their Conditional Use Permit
3. Construct a brick addition to the building for storage of
the tires.
The Auto Mall has decided to apply to amend their Conditional Use
Permit and allow the fenced tire storage area to remain.
Analysis.
Jeff Sweet, representing the Auto Mall, has stated that because the
tenant changed from Firestone to Tires Plus, there is a greater need
for tire storage. Firestone did not have the large volume of used
tires because their business involves car repair activities other than
installing new tires.
As this area is one of the major entrances into the City the staff
felt that any redevelopment on this site must set a high standard for
future development in this area.
When the Auto Mall was being proposed it was presented as a high
quality building, not the typical auto repair type building. After a
substantial number of meetings and discussions, it was finally
approved based on this agreement. The fenced tire storage area
detracts from the whole building. The tire storage area is clearly
visible from the street.
It seems that the concerns of the City and the applicants can be
accomplished with a small brick addition to the back of the Tires Plus
store. If a brick storage area was constructed with a roof, it would
appear as part of the existing building.
Since the fenced storage area was constructed there have been a few
times when the tires have actually exceeded the height of the fence.

Alternatives.
1. Allow the existing fenced tire storage area to remain.
This alternative will allow outside storage at the Auto
Mall.
2. Allow no outside storage as the existing Conditional Use
Permit states. This alternative will make the Auto Mall
remove the existing fenced area.
3. Approve construction of a covered brick addition for
storage of the tires. This alternative will allow the
Auto Mall to construct an area for the tires that
compliments the existing building.
4. Continue for further information. If the Commission
feels that further information is needed, this item
should be continued.

RESOLUTION NO: 88 -22
RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR CONDITIONAL USE PERMIT CUP:88 -4
WHEREAS, an application for a Conditional Use
Permit entitled CUP:88 -4 has been made by Hopkins Auto Mall,
900 -1000 Second Street South, to allow outside storage.
WHEREAS, the procedural history of the application
is as follows:
1. That an application for Conditional Use Permit
CUP:88 -4 was filed with the City of Hopkins on
February 3, 1988.
2. That the Hopkins Planning Commission reviewed
such application on March 29, 1987.
3. That the Hopkins Planning Commission, pursuant
to published and mailed notices, held a public
hearing on March 29, 1987; all persons present
at the hearing were given an opportunity to be
heard.
4. That the written comments and analysis of the.
City staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to Conditional Use Permit CUP:88 -4:
1/1. That outside storage detracts from the
appearance of the Auto Mall.
BE IT FURTHER RESOLVED, that application for
Conditional Use Permit CUP:88 -4 is hereby denied subject to
the following condition
1 1. If brick structure is approved, they must
return to the Commission with detailed plans.
