VARIANCE REQUEST - DALE RUHA
414 Monroe Place
Staff recommends the following motion: The request for a seven (7)
foot sideyard variance is denied.
Adoption of this motion will not allow the applicants to construct
another garage.
The applicant is proposing to construct an addition to the front of
the existing tuck -under garage. This attached garage will,have a 3
foot southerly sideyard setback. The ordinance requires 10 foot
sideyard setbacks. The proposed garage will be 24'x24'.

Detailed Background.
Name of Applicant: Dale & Patricia Ruha
Address of Property: 414 Monroe Place
Present Zoning: R -2
Reason for request: Need additional storage space
Nature of request: A 7 foot southerly sideyard variance
The property is surrounded by residential area on all sides. The
adjacent home to the proposed garage is approximately 10 feet from the
applicants property line.
The applicant has contacted many neighbors, including the abutting
lot, none of which object to the proposed garage.
The Housing Inspector has reviewed the proposed plan. The Building
Code requires at least a three foot setback.

410 The applicant has stated that additional room is needed for storage
and the second car. The applicants situation is not unique. There
are many homes located in Hopkins with only a one ear garage and most
would require a variance if they wanted to expand to a two car garage.
The applicant has reasonable use of the property without the variance.
The applicant does not posses a unique circumstance or hardship to
warrant granting the variance.
1. Grant a seven foot variance. Should you choose this
option, you will have to identify Findings of Fact which
support granting the variance.
2. Deny the variance. By denying the variance the applicant
will not be able to construct the proposed garage.
3. Continue for further information. If the Commission
feels more information is needed, the item should be
continued.

RESOLUTION NO: 88 -31
RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR VARIANCE VN88 -3
WHEREAS, an application for a Variance entitled
VN88 -3 has been made by Dale & Patricia Ruha, 414 Monroe
Place, to construct a garage at less than the minimum
sideyard setbacJC.
WHEREAS, the procedural history of the application
is as follows:
1. That an application for Variance VN88 -3 was
filed with the City of Hopkins on April 1,
1988.
2. That the Hopkins Planning Commission reviewed
such application on April 26, 1988.
3. That the Hopkins Planning Commission, pursuant
to mailed notices, held a public hearing on
April 26, 1988; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the
City staff and the Planning Commission were
considered.
NOW THEREFORE, BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to VN88 -3:
1. That here are no warrants presented by the
applicant in regard to hardship or unique
circumstance to justify the requested variance.
2. That the applicant has reasonable use of the
property with the existing home.
