Proposed Action.
Staff recommends the following motion: That a Conditional Use Permit
be approved by Resolution No: 88 -42 to allow a 10 foot front yard
setback and an 8 foot side yard setback for the mini - storage sign."
Approval of this motion will allow the applicant to place the proposed
sign with a 10 foot front yard setback and an 8 foot side yard
setback.
Overview.
The applicant is presently constructing a mini - storage facility at
1144 Seventh Street South. He is now requesting approval of a
Conditional Use Permit to locate a sign with a lesser setback than
required by the zoning ordinance. The sign as proposed would have a
10 foot front yard setback and an 8 foot side yard setback. The
proposed sign will be located on the northeast corner of the site.

Ordinance 570.47 states " Applications for other proposed sign permits
involving a lesser setback than that required by the zoning code may
be granted only by and under a conditional use permit and under the
applicable provisions and regulations of conditional use requirements
set forth in the zoning code. The conditional use permits may require
periodic reviews and may be canceled for cause."
The proposed sign will be 12'x 6' and 35' in height. A 250 square
foot sign is allowed in an I -1 district.
The sign will be internally lit.
There will be no other signage on the site.
III The building setback and sign setbacks are both 20 feet. A sign
setback should be less than the building setback since it is logical
to believe that the sign for a building is placed in front of the
building. If this sign were to be setback 20 feet from the front and
side property lines the visibility from the intersection of 7th Street
and 11th Avenue would be very poor. The gas station to the east will
be planting trees along their north property line on 7th Street which
will further reduce sign visibility. Staff will be recommending an
ordinance change for sign setbacks in the near future.
- Will the proposed sign have an adverse affect on the surrounding
parcels?
Industrial uses are to the north of the applicants site and the new
gas station to the east, Westbrooke patio homes are to the south and
the landfill is to the west. The proposed sign should have no affect
on any of the surrounding parcels. If the Conditional Use Permit is
granted the sign will be moved further from the residential area. The
sign will be located closer to the gas station but this side is the
rear of the station so the sign will not block the view from the
station.

1. Approve the Conditional Use Permit for a front and
sideyard setback. By granting the Conditional Use Permit
the applicant will be able to erect the sign with a 10
foot front yard setback and an 8 foot sideyard setback.
2. Deny the Conditional Use Permit for a lesser setback. By
denying the Conditional Use Permit the applicant will
have to set the sign 20 feet from each lot line.
3. Approve the Conditional Use Permit for another setback
than proposed. If the Commission feels that there is a
need to have the sign setback further than requested then
it should be moved.
4. Continue for further information. If the Commission
feels that further information is needed, the item should
be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CUP88 -7
WHEREAS, an application for a Conditional Use
Permit CUP88 -7 has been made by Paul Steiner, 1144 Seventh
Street South, to place a sign with a lesser setback is
approved.
WHEREAS, the procedural history of the application
is as follows:
1. That an application for Conditional Use Permit
CUP88 -7 was filed with the City of Hopkins on
May 3, 1988.
2. That the Hopkins Planning Commission reviewed
such application on May 31, 1988.
3. That the Hopkins Planning Commission, pursuant
to published and mailed notices, held a public
hearing on May 31, 1988; all persons present at
the hearing were given an opportunity to be
heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP88 -7:
1. That the proposed sign will not affect the
surrounding parcels.
2. That the proposed sign meets the ordinance
requirements except for the setback.

SUBJECT: Revision to the mini - storage landscape plan
Mr. Steiner is currently constructing the mini - storage
facility on 7th Street South. Mr. Steiner wants to revise
the landscape plan for the facility. He is proposing to use
smaller plantings in clusters long the front of the mini -
warehouse.
Mr. Steiner's situation is unique. The type of use requires
large buildings and a lot of parking. These circumstances
make it difficult to provide areas for landscaping. The
number of plantings proposed does not meet the landscaping
requirements for the building floor area, but it does for
site perimeter.
The Commission does have the option of granting a waiver for
both size and quantity if compliance will restrict the
parking. In this situation every individual rented storage
area needs parking. The only practical area to landscape is
the front yard of the site. The landscape plan that Mr.
Steiner is proposing will not over power the front with
plantings, but provide a well balance appearance for the
size of the structures.
The action required is to accept the revised landscape plan.
