MEMORANDUM DATE: September 13, 1988 TO: Zoning & Planning Commission FROM: Nancy S. Anderson k SUBJECT: Sideyard setbacks for Industrial Districts Attached is an ordinance that would allow additions to existing industrial buildings to have the same sideyard setback if greater than 10 feet. The previous ordinance allowed sideyards of 10 and 15 feet. This ordinance would not allow additions to follow the existing sideyard setback if the building abutts a residential district. CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE NO: 88 -622 AN ORDINANCE AMENDING HOPKINS ZONING ORDINANCE NO: 540 PERTAINING TO INDUSTRIAL SIDE YARD SETBACKS BE IT ORDAINED, by the City Council of the City of Hopkins as follows: That the Hopkins Zoning Ordinance No. 540 be and the same is hereby amended by adding the following provisions: * ** JAMES A. Bajr, Inc. to construct a restaurant, gas station and convenience store at the southeast corner of 11th Avenue South and County Road #3, is approved with Conditions. WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP88 -16 was filed with the City of Hopkins on October 4, 1988. 2. That the Hopkins Planning Commission reviewed such application on October 25, 1988. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on October 25, 1988: all persons present at the hearing were given an opportunity to be heard. 4 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. That the proposed buildings meet the requirements for a B -3 district. 2. That the proposed uses are permitted in a B -3 district. That the applicant arrange for. the acquisition of the City property. 2. That an adequate roadway to 8th Avenue is constructed by the applicant. 3.
