CONDITIONAL USE PERMIT - HAGEN
33 - 10th Avenue South
Proposed Action.
Staff recommends the following motion: "Move that the request to allow
parking in the 20 foot green area adjacent to the East 1/2 of the
Downtown. Park is allowed ".
This action will allow the applicant to use the 20 foot green area
adjacent to the Downtown Park.
Overview.
The applicant, Mr. Hagen, is one of the owners of the Hopkins Office
Center at 33 Toth Avenue South. The Hopkins Office Center and the old
Schoell & Madson building at 50 9th Avenue South currently share 91
existing parking spaces;. Both office buildings are almost at 100%
occupancy and are experiencing a shortage of parking.
The site plan submitted by Mr. Hagen shows 34 new spaces will be added
to the site The site is zoned B-2 which does not have any parking
requirements or landscaping requirements. Staff is recommending
approval because the area will be used for parking only which will
allow sunlight into the park.

When the Hopkins Office Building Conditional Use Permit was approved
on September 2, 1980, one condition was that a 20 foot green area be
retained as a buffer zone adjacent to the East 1/2 of the Downtown
III Park. Mr. Hagen is requesting this condition be removed to allow
parking in this 20 foot green area

The existing parking lot has 91 spaces which are shared by the Hopkins
Office Center and the building at 50 -9th Avenue South. The existing
parking lot stops approximately 44 feet from the City Park. This area
is currently green space.
The parking lot currently has access from First Street South and 9th
Avenue. The access will remain the same with the additional parking.
The new proposed parking area will have a new entrance /exit on 9th
Avenue. The existing parking lot will be remarked slightly to move .
the spaces further south. The existing entrance /exits will be changed
where necessary. The new parking spaces are 8 x 16 which is the size
for compact cars.
The Director of Engineering has reviewed the proposed site plan and
found it acceptable.
IIII Staff Analysis of Issues:
What was the purpose of the 20 foot buffer?
In researching the past actions, the buffer area was required because
any construction would block sunlight into the park. In looking at
the existing conditions, it appears that the existing hill serves as a
buffer and will block the sight line of the cars from the park. The
parking area will not affect the park.
s the additional parking needed?
One of the reasons the parking ramp was needed was a lack of parking.
The applicant has stated that one of the leasing features of his
building is free parking. Thirty -four additional spaces can be added
to the site which will take considerable parking pressure away from
the site.
Is there any other alternative for the applicant?
There is the alternative of allowing only one row of parking on the
south end of the 44 foot strip. This would increase the parking area
by 17 spaces. Sixteen feet would remain as green space with one row
of parking.

Alternatives.
1. Approve the additional parking. This alternative will
allow the applicant to construct 34 additional parking
spaces.
2. Deny the additional parking. This alternative would not
allow the applicant to construct the 34 additional
parking _spaces.
3. Allow only one row of parking. This will allow a green
space of 16 feet.
4. Continue for further information. If the Commission feels
that further information is needed, the item should be
continued.

ATTACHED NARRATIVE
When the Hopkins Office Center, (H.O.C.), was started in the fall of 1981,
we designed a parking lot which we wanted to be jointly shared with the
old Schoell and Madson building on the corner at 50 -9th Avenue South.
Twenty parking spaces were laid out on the south end of the H.O.C. building,
and 70 on the east side, and 7 behind 50 -9th Avenue South for a total of
87 spaces.
The strip of land from the building east to 9th Avenue was left as undeveloped.
Discussion from the city suggested that this could be a future site for an
additional office building at sometime. We suggest that at some point it
might be needed for additional parking but we would not do anything with it
until the need was shown. One person on the council wanted an open strip
between our parking lot and the ciyt park so that the changes to other uses
could come before the council for approval and that was the way it was
approved.
Both office buildings have been at almost 100% occupancy for some time and
parking for our tenants has become a problem. At times our lot is 100%
full and some tenants cannot park in our lot when they leave and return to
their offices during the day. The 2 hour parking on 10th Avenue South and
on the one side of 9th Avenue South eliminates the street parking for workers
who do not leave the building during the course of the day. We do not expect
the new city ramp to help our situation because we already discourage outsiders,
(past office employees and tenants of the Norwest Bank Building), by threatening
to tow their cars.
Plenty of free adjacent parking to a tenants office has been one of the great
incentives of all suburban office buildings. We need the extra parking spaces
to help keep the H.O.C. and 50 -9th Avenue South building filled.

RESOLUTION NO: 89 -4
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP88 -18
WHEREAS, the original Conditional Use Permit for
the Hopkins Office Center required a 20 foot green area
between the Downtown Park and the parking area of the
Hopkins Office Center, and
WHEREAS, Mr. Hagen has now applied for a
Conditional Use Permit entitled CUP88 -18, to amend the
original Conditional Use Permit to allow parking in the 20
foot green area is approved.
WHEREAS, the procedural history of the application
is as follows:
1. That an application for Conditional Use Permit
CUP88 -18 was filed with the City of Hopkins on
December 2, 1988.
2. That the Hopkins Planning Commission reviwed
such application on December 27, 1988.
3. That the Hopkins Planning Commission, pursuant
to published and mailed notices, held a public
hearing on December 27, 1988: all persons
present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permr}CUP88 -18 is hereby approved subject
to the following Findings of Fact:
r 1 That the additional parking area will provide
additional parking for the applicant.
BE IT FURTHER RESOLVED, that application for
Conditional Use Permit CUP88 -18 is hereby approved subject
to the following Condition:
That the 20 foot buffer area is only used for
parking.
