11-29-1988A regular meeting_of the Hopkins Zoning and Planning Commission was ill held on Tuesday, November 29, 1988, at 7:30 p.m., in the Council Chambers of the City Hall. Present were Chairman E. Anderson, members R. Anderson, Maxwell, Novak, Pavelka, Richardson and Woodrich Jr. Also present was Community Development Analyst N. Anderson. Item: Ms. Richardson moved and Mr. Maxwell seconded a motion that the minutes of the October 25, 1988 meeting be approved and signed. Motion carried unanimously. CASE NO: CUP88 -17 HAROLD STIELE (4 -43) Hearing to consider an application by Harold Stiele for a Conditional Use Permit to renovate the interior and exterior of the structure at 918 -924 Mainstreet and 3 - 5 - 10th Avenue South. Mr. Stiele appeared before the Commission and reviewed the plans for the proposed renovation. He stated that brick would be added to 3 - - 10th Avenue South and that the existing exterior would be cleaned to the original brick. He noted that the building would be used for retail on the main floor and residential on the second floor. The Commission noted that they had approved other renovations in the downtown and that this project should also be approved. There was no one present in opposition to the project. Mr. Woodrich moved and Ms. Richardson seconded a motion recommending to the Council approval of CUP88 -17 with the Findings of Fact: 1. That the renovation meets the development plans for the area; 2. That the renovation will comply with the Hopkins Downtown Design Guidelines. Motion carried unanimously. CASE NO: ZN88 -5 LEADENS INVESTIGATIONS (44 -334) Hearing to consider an application by Leadens Investigation & Security Inc. to rezone from R- 1 -C /B -3 to B -1 all of 1202 East Excelsior Avenue and the north 13 feet of 7 Blake Road South. Mr. Ed Kodet of Architectural Group, Inc. reviewed the proposal with the Commission. He stated that Mr. Leadens would like to enlarge the existing building and build a new house on the property to the south. The existing residence at 11 Blake Road South would be demolished. The proposed office addition would be the same roof height, and the architecture would be reflective of the present building. Mr. Leadens stated that he does not intend to sell the property, it is to remain in the family. Staff stated that the proposed B -1 zoning is more restrictive then the present B -3 zoning on the property. Z & P Minutes 11/29/88 Page 2 Residents from the area stated their concerns about the rezoning. They are opposed to the rezoning fearing that it will continue to infringe into the residential neighborhood. They feel that the property could be used for parking sometime in the future. They were pleased with the prospect of a new home at 11 Blake Road. Residents asked if covenants could be placed on the property. It was noted that the City cannot place covenants on the property but that something may be worked out with the neighborhood association. Mr. Leadens invited the residents to visit his office and perhaps they can come to some understanding. Mr. E. Anderson asked that the City Attorney be contacted for his opinion on exactly what can be constructed on the property with the present zoning. ATTEST: Mr. Woodrich moved and Ms. Richardson seconded a motion that the hearing be continued to December 27, 1988 giving time for a response from the City Attorney and time for the neighborhood to work with Mr. Leadens. Motion carried unanimously. CASE NO: WVR88 -3 LEADENS INVESTIGATIONS Hearing to consider an application by Leadens Investigation & Security Inc. for a waiver of the platting requirements to allow division of the empty lot immediately south of 1202 East Excelsiro Avenue. Mr. Woodrich moved and Ms. Richardson seconded a motion to continue this hearing to the December 27, 1988 meeting due to the continuation of the rezoning request. Motion carried unanimously.
