05-31-1988• • A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, May 31, 1988, at 7:30 p.m., in the Council Chambers of the City Hall. Present were Chairman E. Anderson, members Denny, Ebel, Maxwell, and Richardson. Also present was Community Development Analyst Nancy Anderson. ITEM: (6 -8) Mr. Maxwell moved and Mrs. Ebel seconded a motion that the minutes of the April 26, 1988 meeting be approved and signed. Motion carried unanimously. CASE NO: VN88 -2 CHARLES ALBERTSON (9 -10) Hearing to consider an application by Charles Albertson for a Variance to construct an addition with a lesser sideyard then allowed and to exceed the maximum floor area ratio at 601 12th Avenue South, continued from the April 26, 1988 meeting. Applicant requested withdrawl of the request. CASE NO: ZN88 -3 CITY OF HOPKINS (10 -12) Hearing to consider an amendment to the Zoning Ordinance in regard to fences around swimming pools, continued from the April 26, 1988 meeting. Ms. Richardson moved and Mr. Denny seconded a motion that the hearing be continued to the June 28, 1988 meeting for additional information. Motion carried unanimously. CASE NO: CUP88-7 PAUL STEINER (204 -238) Hearing to consider an application by Paul Steiner for a Conditional Use Permit to place a sign with a lesser setback than required by ordinance at 1144 Seventh Street South, site of the Fortress Mini- Storage facility. Mr. Steiner appeared before the Commission. He stated that the lesser setback was needed for visibility. It was noted that the sign would face east /west, would be internally lighted, and not be visible from the Westbrooke Patio homes. No one appeared regarding this request. Ms. Richardson moved and Mr. Maxwell seconded a motion recommending to the Council approval of the application for a Conditional Use Permit to place a sign with a lesser setback with the Findings of Fact: 1. That the proposed sign will not affect the surrounding parcels. 2. That the proposed sign meets the ordinance requirements except for the setback. Motion carried unanimously. • Z & P Minuest of 5/31/88 Page 2 ITEM: CASE NO: CUP88 -8 R.L. JOHNSON INVESTMENTS (15 -163) Hearing to consider an application by R.L. Johnson Investments for a Conditional Use Permit to construct a strip mall with a restaurant and six commercial /business spaces to be located at the southeast corner of County Road #3 and llth Avenue South. Mr. Jim Justus asked the size of the restaurant area. Mr. Constable stated that the restaurant would be approximately 4000 square feet with a seating capacity for 150 . The Commission felt that is was necessary to have the CCDC review the proposal before action was taken. They also stated concern about a traffic study being made. Staff informed the Commission that the CCDC would be reviewing the proposal on Thursday and that the intersection will be up- graded in the near future. Ms. Richardson moved and Mr. Denny seconded a motion that the hearing be continued to the June 28, 1988 meeting giving the CCDC time to review the proposal and also to have information from recent traffic counts for that intersection. Motion carried. Chair voting nay. CASE NO: CUP88 -9 BATON CORPORATION (165 -202) Hearing to consider an application by Baton Corporation to revise their Conditional Use Permit to allow more condominiums in place of the proposed townhouses at llth Avenue South & First Street. Mr. Steve Embretsen of Baton Corporation appeared before the Commission. He stated that they are requesting this change because of the demand for condos. It was noted that the access to the condos was changed from llth Avenue to 12th Avenue and that the setback from Suburban Chevrolet would be more desirable. Mr. Embretsen also stated that all units will be owner occupied. Discussion regarding a revised landscape plan for the Fortress Mini - Storage site, 1144 Seventh Street South. Staff feels that the revised plan is appropriate for the development. The Commission had no objections to the revised plan. Mr. Dave Constable reviewed the request with the Commission. He stated that the proposal meets the parking and setback requirements. • Z & P Minutes of 5/31/88 Page 3 Mr. Denny moved and Ms. Richardson seconded a motion recommending to the Council approval of the Conditional Use Permit with the Findings of Fact: 1. That the revised plans minimize the granted variances, 2. That the density of the added units conforms with the district requirements; and with the Conditions: 1. That the applicant and the City execute .a revised Redevelopment Plan, 2. Approval by HRA of revised plan. Motion carried unanimously. CASE NO: VN88 -6 CITY OF HOPKINS Hearing to consider an application by the City of Hopkins for a Variance to allow two off - premise signs at the north side of the municipal parking ramp to be located north of the Norwest Bank.
