03-29-1988A regular meeting of the Hopkins Zoning and Planning Commission was held March 29, 1988, at 7:30 p.m., in the Counci]. Chambers of the City Hall. Present were members R. Anderson, Brandon, Denny, Maxwell, McGlennen and Richardson. Also present was Community Development Analyst Anderson. In the absence of Chairman E. Anderson, Mrs. Brandon chaired the meeting. Mr. McGlennen moved and Mr. Denny seconded a motion that the minutes of the February 23, 1988 meeting be approved and signed. Motion carried unanimously. CASE N0: ZN88 -1 STOBBE DEVELOPMENT COMPANY (3 -5) Hearing to consider an application by Stobbe Development company to rezone the property located at the southeast corner of State Highway #7 and county Road #18 from R -2 Residential to R -4 Residential to allow construction of a 63 unit apartment building, continued from the February 23, 1988 meeting. CASE NO: CUP 88 -1 STOBBE DEVELOPMENT COMPANY (5 -6) Hearing to consider an application by Stobbe Development Company for a Conditional Use Permit to allow construction of a 63 unit apartment building to be located at the southeast corner of State Highway #7 and County Road #18, continued from the February 23, 1988 meeting. Council continued this hearing to the April 26, 1988 meeting at the request of the applicant. CASE NO: CUP88 -5 STOBBE DEVELOPMENT COMPANY (7 -118) Hearing to consider an application by Stobbe Development Company for a Conditional Use Permit to allow removal of more than 400 cubic yards of soil from the property located at the southeast corner of State Highway #7 and County Road #18, future site of the 63 units apartment building. Council continued this hearing to the April 26, 1988 meeting at the request of the applicant. Mr. Norm Wells, architect for Mr. Stobbe, explained to the Commission that they would be removing 600 -700 cubic yards of soil which would be used at another site. The subject site has more than is needed for the proposed development of the apartment project. Mr. Wells stated that due to road restrictions they would not be able to haul from the site until later in the spring. Zoning &Planning Commission Minutes of 3/29/88 Page 2 Kevin Stobbe, son of Mr. Stobbe, stated that financing for the apartment has been cleared. They anticipate starting construction of the apartments sometime in June for a spring of 1989 occupancy. It was stated that the removal of the soil would not leave the site undeveloped for a long period of time. Mr. McDonald of 229 Campbell Drive stated that the residents would not like to see the area disturbed for a period of time prior to construction. Approval of the Conditional Use Permit for construction of the apartments and rezoning of the property is contingent on an Environmental Assessment Worksheet which should be forwarded to the City shortly. Mr. Maxwell moved and Mr. Denny seconded a motion that the Conditional Use Permit for removal of more than 400 cubic yards of soil be continued to the April 26, 1988 meeting at which time the Commission may be able to act on all three requests. Motion carried unanimously. CASE NO: CUP88 - HOPKINS AUTO MALL (119 - 225) Hearing to consider an application by the Hopkins Auto Mall, 900 -1000 Second Street South, for a Conditional Use Permit to allow an outside screened storage area. Mr. Jeff Sweet, President of the Auto Mall, reviewed the proposed storage area with the Commission. He stated that they would be willing to build a brick structure with the same type of roof as the existing building. He also stated that they would like to build the structure on a floating slab and not use footings. The proposed structure would be the same size as the existing enclosure but meet the roof line of the existing building. Mr. McGiennen moved and Ms. Richardson seconded a motion recommending to the Council approval of the Conditional Use Permit to construct an outside storage area with the Findings of Fact: 1. That the existing outside storage detracts from the appearance of the Auto Mall; and with the Condition: 1. That the Building Inspector approve final plans of the structure. Motion carried unanimously. ITEM: HEARING (226 -241) Public hearing to consider amending the Zoning Ordinance in regard to side yards in Industrial District. Ms. Richardson moved and Mr. Denny seconded a motion that the proposed ordinance be sent back to the City Attorney for clarification and that the hearing be continued to the April 26, 1988 meeting. Nancy Anderson reviewed a proposal with the Commission. At the present time the Zoning Ordinance does not address private swimming pools. The Inspection Department feels there is a need to have some regulations on private swimming pools. Mr. McGlennen moved and Mr. Denny seconded a motion that a hearing be set for the April 26, 1988 meeting and staff have an ordinance drafted. Motion carried unanimously.
