Use Permit-Accent EngravingPanning Commission Report CONDITIONAL USE PERMIT Accent Engraving - 1600 Second Street South PLANNING COMMISSION REPORT: CUP87 -2 PURPOSE: To review and recommend action on a Conditional Use Permit to locate a sign in a lesser setback. BACKGROUND: Name of Applicant: Accent Engraving Address of Property: 1600 Second Street South Present Zoning: I -1 Nature of Request: Ordinance requires a Conditional Use Permit for signs with a lesser setback than required. Reason for Request: To locate a sign in a lesser setback than required. The applicant is in the process of adding signage above the existing planter. NAPCO has sold the building which presently has multiple tenants who desire signage on the property. The proposed sign will be approximately .48 feet from the County right -of -way and approximately 19 feet from the edge of the curb. The ordinance requires a 75 foot setback. Ordinance 570.47 states applications for other proposed sign permits involving a lesser setback than that required by the zoning code may be granted only by and under a conditional use permit and under the applicable provisions and regulations of conditional use requirements set forth in the zoning code. The proposed sign will be approximately 16 feet high, 18 1/2 feet wide, post to post and contain 117 square feet of signage per side. The planter does contain an existing sign approximately 18 square feet. NO. CUP87 -2 January 15, 1987 CUP87 -2 Page 2 The proposed sign will consist of 8 double faced signs of approximately 16 square feet each. The applicant is proposing to use Laxan for the sign face. The sign meets all other requirements for signs in that district. ANALYSIS: The great distance the applicant is required to have the sign set back is due to the fact that the property abutts a Residential District which requires a 75 foot setback. The Ordinance does not have setbacks for signs, they are regulated by the building setbacks. This problem will be addressed in the ordinance changes in the near future, with a recommendation of a 10 to 20 foot setback. However in this situation a setback of 10 to 20 feet might not be reasonable because of the existing buildings proximity to the road. The proposed sign is not of great size by itself, however with the planter below it, it becomes quite a large structure consisting of 276 square feet. The proposed sign is not attached to the planter in any way and could exist independently. The proposed sign with the planter will be larger than a billboard, however if applicant removes the planter it will reduce the overall bulky appearance of the structure without reducing the signage by a great deal. ALTERNATIVES: 1. Allow the sign to be erected with .8 foot setback with the planter below. 2. Allow the sign to be erected with an .8 foot setback, with the planter removed. 3. Disapprove the request. 4. Approve the Conditional Use Permit with a larger setback. RECOMMENDATION: I recommend approval of the sign as proposed by the applicant with the planter removed.
