PLANNING COMMISSION

PURPOSE: To review and recommend action on
Conditional Use Permit for allow Day Care.
BACKGROUND:
Name of Applicant: Debra Packard
Address of Property: 83 Renaissance Court
Present Zoning: R -3
Nature of Request:, Statute allows the City to
require a Conditional Use Permit in
multiple residential districts.
Reason for Request: To allow Day Care in a
multiple residential district.
The applicant is applying for a Day Care license which -
requires her to get a Conditional Use Permit before
obtaining a license.
The State Statute states a township, municipality or
county zoning authority may require a Conditional Use
Permit or Special Use Permit in order to assure proper
maintenance and operation of a facility, provided that
no conditions shall be imposed on the homes which are
more restrictive than those imposed on other
conditional uses or special uses of residential
property in the same zones, unless such additional
conditions are necessary to protect the health and
safety of the residents of the family.
The applicant lives within a townhouse development
which does not allow a great amount of room for the
children to play, however, there is a common play area
for the children.
The applicant has contacted the manager of the
townhouses and received written approval which is
enclosed.

ANALYSIS: The State Statute allows Day Care in a multi-
family residential area as long as it is licensed. The
only control the City has is a reviewing process
through a Conditional Use Permit to assure proper
maintenance and operation of a facility.
RECOMMENDATION: I recommend approval of the Conditional
use Permit. the following are suggested Findings of
Fact and Conditions should the Commission recommend
approval:
Findings of Fact:
1. That the applicant meets the conditions for a
Conditional Use Permit.
Conditions:
1. That the applicant is licensed by the State
of Minnesota.
2. That the residence is inspected by the City
Inspectors.

I was- requested by Debra Packard to write a letter for
her as to the position of the Renaissance on her doing
day -care in her home. !s.Packard resides at 83 Renaissance
Court.
The Renaissance Management has no problem with Ns. Packard
doing day -care. Renaissance does not except any respon-
siblity for any liability that may arise between Ms. Packard
and her day -care children /parents, etc. we will not be
responsible for any requirements she must meet to qual-
ify to preform said day -care in her home.
