SUBDIVISION REQUEST - 7TH STREET & 11TH AVE.
PLANNING COMMISSION
REPORT NO: SUBD87 -1 MARCH 23, 1987
PURPOSE: This report is to review and recommend action
on an application for a preliminary subdivision on the
southwest corner of 7th Street south and 11th Avenue
South.
BACKGROUND:
Name of Applicant: Jack Welch
Address of Property: Southwest corner of 7th
Street South & 11th Avenue South.
Present Zoning: B -3
Reason for Request: To divide a 39,073
square. foot. parcel into parcels of
approximately 11,739 square feet and 27,308
square feet.
Nature of Request: To secure separate
mortgages for two business developments.
This subdivision is in conjunction with the Conditional
Use Permit application at this site to construct a
convience store and car wash.
The applicants are requesting the subdivision in order
to secure separate mortgages.
The following are the minimum requirements for a lot in
a B -3 District:

ANALYSIS: The lots meet the minimum requirements for a
lot in the B -3 District. If the applicant were to ask
for the division without the Conditional Use Permit
there would be no reason to justify denial. Both of
the new lots would meet all requirements of the
ordinance.

The Commission always has the option of continuing an
item. If the Conditional Use Permit is continued for a
month, the subdivision should also be continued.
This is a preliminary subdivision approval. If
approved, the applicant will be back for a final
approval. Since the proposed buildings have a zero
side lot line we are recommending that the final
subdivision approval not be given until the proposed
buildings are in the construction stage so a survey can
be taken for an exact location of the buildings. It is
important that the buildings are situated correctly to
avoid any problems in the future of having a building
encroaching on the abutting lot.
ALTERNATIVES:
1. Approve the subdivision, contingent on
approval of the Conditional Use Permit.
2. Deny the subdivision
3. Continue for further information
4. Approve the subdivision, without approving
the Conditional Use Permit.
RECOMMENDATION: I recommend Alternative #1. The
following are Findings of Fact and Conditions should
the Commission recommend approval.
1. That the subdivision meets the minimum
requirements for lots in a B -3 District.
Condition:
1. That the Conditional Use Permit is approved
for the car wash /convenience store.
