Use Permit-Super ValuPLANNING COMMISSION REPORT NO: CUP87 -7 Planning Commission Report -, CONDITIONAL USE PERMIT - SUPER VALU MARCH 24, 1987 PURPOSE: To review and recommend action on an application for a Conditional Use Permit to construct an addition to the existing Super Valu Building. BACKGROUND: Name of Applicant: Super Valu Stores Inc. Address of Property: 101 Jefferson Avenue South Present Zoning: I -2 Reason for Request: Needed expansion space Nature of Request: Ordinance requires construction over $75,000 to obtain a Conditional Use Permit. The applicant is proposing to construct a 9000 square foot addition with six loading docks to the south side of the existing dry goods loading area adjacent to Third Street South. Ordinance 525.13 requires a Conditio al Use Permit whenever a building permit request;a is for new construction or for the enlargement, remodeling repair of the exterior of any existing building including structures accessory thereto, at a cost of at least $75,000, except one through four family structures. ANALYSIS: The subject property abutts a residential district along Monroe Avenue and Third Street South. Because of this situation the ordinance requires a 40 foot rear yard setback and loading docks to have a 50 foot setback. The proposed addition is not parallel to the lot line. The loading dock area will have approximately a 52 foot setback, which then tapers to approximately 4 +3 feet at the easterly end. The plan as proposed will have a 15 foot concrete block wall screening the loading area from the residential No. CUP87 -7 CUP87 -7 Page 2 district along Third Street South. The wall will be painted to match the existing building. The addition is at a lower elevation than the abutting residential district. With the wall, difference in elevation and the existing fence, noise and visual impact should be minimal to the homes along Third Street South. A 20 foot wide access road will be maintained between the proposed building and the lot line. This road will provide access to the parking lot east of the addition. The Floor Area Ratio is .55. The maximum requirement for an I -2 District is .60. The site is close to maximum development. A 12" watermain will have to be relocated because of the proposed building. The applicant will move the watermain to the south side of the addition for which the City will require a 15' easement. The City Engineer has reviewed these plans and found them acceptable. The applicant will have to petition to vacate the existing utility easement on Second Street South. The exterior of the building will be painted concrete block to match the existing building. The addition will also have a canopy to match the existing building. The addition will require five more parking spaces, which the applicant will provide. Any future additions will require the applicant provide additional spaces. The applicant may seek a parking variance for future additions. The Fire Marshal has reviewed the preliminary plans, but was out of town during the writing of this report. Any approval should be contingent upon his approval. The Director of Engineering has reviewed the plans and found them acceptable. The applicant requires additional space for their business. The proposed addition complies with the requirements for an I -2 district and a conditional use CUP87 -7 Page 3 permit. The addition should have a minimum impact on the abutting residential district the the south because of the wall screening the loading area and the elevation difference. ALTERNATIVES: 1. Approve the Conditional Use Permit. 2. Deny the Conditional Use Permit. 3. Continue for additional information. RECOMMENDATION: I recommend Alternative #1.
