Waiver of Plat Requirements-Uppals Add.Planning Commission Report -� WAIVER OF PLATTINIG.REQUIREMENTS Uppals Addition PLANNING COMMISSION REPORT NO: WVR87_1 MARCH 23, 1987 PURPOSE: This report is to review and recommend action on an application for a Waiver of the Platting Requirements. BACKGROUND; Name of Applicant: Bohan Uppal Address of Property: Lots 3, 4 and 5, Uppals Addition Present Zoning: R -2 Reason for Request: Building two,- four family dwellings instead of previously approved ten units. Nature of Request: To divide 3 lots into 2 lots of 20,242 square feet and 20,347 square feet. The applicant is proposing to divide three existing lots into two for the purpose of constructing two, four family dwellings. In July 1985, the applicant applied for and was granted sideyard variances and a Conditional Use Permit to construct 10 townhomes on the three subject lots. The Conditional Use Permit was granted a one year extension on July 1, 1986. Since the granting of the extension, the applicant wishes to construct two, four family dwellings instead of the 10 townhome units. A 2 -4 family dwelling is permitted within the R -2 District. The applicant would not be required by the Zoning Ordinance to obtain a Conditional Use Permit for construction of the project. because 1 thru 4 family structures do not require one. The applicant has not applied for any variances in connection with the construction of the 4- plexes, these dwellings will have to comply with the minimum requirements of the zoning district. The following is a listing of how the proposed project complies with R -2 lot requirements: No. WVR87 -1 • ■ WVR87 -1 Page 2 Lot Size Lot Width R -2 12,000 100 North Lot - 20,242.24 136 South Lot - 20,347.44 136.56 The area around the subject site consists primarily apartments and other multiple family type dwellings. The subject property boarders Nine Mile Creek. Any building will require an approved plan from the Nine Mile Creek Watershed District as well as final review by the Director of Engineering for Flood Plain encroachment and drainage. Access to the lots will be from 9th Avenue. Proposed Lots ANALY *SIS: The Hennepin County Recorder has told the applicant the waiver would be acceptable. Both lots meet the minimum requirements for an R -2 District. The Commission does have the option of requiring the applicant to go through the formal platting procedures, but the results would be the same since the lots are conforming to the disrict. Past policy is to grant a waiver from the platting process on a simple division. The Commission also has the option of continuing the application. This does not seem logical since it appears all necessary information has been provided by the applicant. ALTERNATIVES: 1. Approve the waiver of the plat with the condition it is accepted by the Hennepin County Recorder. 2. Require the applicant to go through the regular subdivision procedure. 3. Continue the waiver for further information. RECOMMENDATION: I recommend Alternative 11. The following are Findings of Fact and Conditions should the commissison recommend approval: 1.
