Use Permit-Hopkins Commerce CenterPlanning Commission RePort CONDITIONAL USE PERMIT - HOPKINS COMMERCE CENTER PLANNING COMMISSION REPORT NO: CUP87 -18 JUNE 18, 1987 PURPOSE: To review and recommend action on an application for a Conditional Use Permit to construct a pylon sign with a 5 foot setback. BACKGROUND: Name of Applicant: Hopkins Commerce Center Address of Property: 1007 -1 ;0121 Excelsior Avenue East Present Zoning: B -3 _ Reason for Request: Compliance with 10 ft setback provided by the ordinance would place the pylon in the driveway. Nature of Request: Reduce setback from 10 feet to 5 feet. This application is in conjunction with an application for a variance to allow for more signage than permitted by ordinance. The applicant is proposing to place a pylon sign with a 5 foot setback. The ordinance requires a 10 foot setback for a side yard abutting a state or county road. Ordinance 570.47 states: "Conditional Use Permit: Applications for other proposed sign permits involving a lesser setback than that required by the zoning code may be granted only by and under a conditional use permit and under the applicable provisions and regulations of conditional use requirements set forth in the zoning code. The conditional use permits may require periodic reviews and may be cancelled for cause." The ordinance was a few years ago to allow lesser setbacks for signs to better accommodate requests of this type. No. • CUP87 -18 Page 2 The proposed pylon sign will replace an existing pylon sign. The existing pylon sign to be removed is a single sign in poor condition. The existing pylon sign is located in a parking space, the new proposed pylon sign will also be located in a parking space. The applicant will be putting up new fascia signs on the adjacent strip mall and in conjunction with this remodeling is also proposing to erect a new pylon sign and extend the existing pylon sign the east side of this mall. Blake School is to the south, which because it is setback a great distance, should not have a negative impact. Businesses are located on the east and west and the mall to the north. The proposed sign is consistent with the existing signage. The new pylon sign will have three 6x6 panels for a total of 108 square feet per side. Each 6x6 panel is a separate sign, hence the pylon sign will not exceed the maximum size of 80 square feet. The panels will be attached to 12 inch square columns. The sign will be internally lite and made of lexon. The proposed pylon sign will be 30 feet high. The maximum height for a free standing sign is 35 feet. The Director of Engineering has reviewed the placement of the sign for visibility and found the 5 foot setback acceptable. Our ordinance has greater setbacks for county roads. If Excelsior Boulevard were not a county road the applicant would have a 0 setback and therefore the sign would be acceptable as proposed. The placement of the sign will not interfer with visibility of the traffic on County Road 3. In placing the sign to the north 5 feet it would then extend into the driveway area of the applicants parking area. With the removal of a number of the older signs on the site, the new signage as proposed should provide a neater, more uniform appearance. ALTERNATIVES: 1. Approve the Conditional Use Permit 2. Deny the Conditional Use Permit 3. Approve the Conditional Use Permit with greater setback then 5 feet 4. Continue for further information CUP87 -18 Page 3 RECOMMENDATION: I recommend approval of the Conditional Use Permit. The following are suggested Findings of Fact and Conditions should the Commission recommend approval: 1. That the proposed sign meets the requirements for a signin a B -3 district. 2. That the 5 foot setback will not affect the visibility on County Road 3. Conditions: 1. That a sign permit is secured and the electrical inspector approves the plan.
