Use Permit-Super Valu• PLANNING COMMISSION REPORT NO: CUP87 -19 Planning Commission Report CONDITIONAL USE PERMIT - SUPER VALU 715 Fifth Street South JUNE 24, 1987 PURPOSE:To review and recommend action on an application for a Conditional Use Permit to construct truck maintenance facilities. BACKGROUND: Name of Applicant: Super Valu Stores, Inc. Address of Property: 715 Fifth Street South Present Zoning: I -1 Reason for Request: Super Valu has out -grown the existing facilities at 101 Jefferson Avenue South. Nature of Request: Ordinance requires a Conditional Use Permit for construction over $75,000. The applicant is relocating the truck maintenance facilities from the present site at 101 Jefferson Avenue South to the perishable site at 715 Fifth Street South. This development was discussed at the time the perishable warehouse was constructed. The proposed construction will consist of a 31,250 square foot tractor parking building, a 14,800 square foot truck maintenance building with a trailer wash and fuel islands. This construction will be located southwest of the existing perishable building which is now a grassy area. The fuel islands will be covered with a canopy. A concrete pad for parking 25 trailers will be constructed on the northwest side of the site. Access to the site will remain the same. The subject site is surrounded by the new R.L. Johnson office /warehouse to the east, baseball park to the west, the R.L. Johnson vacant property to the north and a residential area to the south. There are two buildings on the south side of the block which are not part of the Super Valu property. No. CUP87 -19 Page 2 The new construction will comply with the building setbacks. The only building close to the lot line is the southern side of the tractor parking which has the required 20 foot setback. The height is approximately 20 feet. The exterior of the maintenance building and tractor parking will be concrete panels. The applicant is proposing a beige color with a darker brown for accents. The applicant is working with different combinations of block to provide a more pleasing appearance. The applicant is proposing that the canopy over the fuel pumps will be metal and brown in color. The Nine Mile Creek Watershed District has reviewed the plans and found them acceptable. A small portion on the east side of the site is in the floodplain. The southern part of the Super Valu site where the proposed construction will take place is surrounded by a screened fence and landscaped with evergreens. The proposed construction will meet the requirements of the landscape ordinance with the existing trees. 84 marked parking spaces will be added with the proposed construction. The parking area will be hard surfaced. The applicant is required to have 38 spaces. The applicant is proposing that most traffic will come from 6th Avenue to the ingress /egress on 5th Street South. This is the route most vehicles take now except they use the ingress /egress at the northern part of the site. The Fire Marshal has reviewed the plans, and noted that the fuel pumps will have to comply with the state requirements. The Director of Engineering has reviewed the plans and found them acceptable. CCDC will be reviewing the plans. As of the date of this report, they had not reviewed them. ALTERNATIVES: 1. Approve the Conditional Use Permit 2. Deny the Conditional Use Permit 3. Box 1243 Minneapolis, Minnesota 55440 Nine Mile Creek Watershed District May 20, 1987 Re: Expansion of Super Valu Truck Maintenance Facility: Hopkins Dear Mr. Linner: 4344 IDS CENTER MINNEAPOLIS, MINNESOTA 55402 The Board of Managers of the Nine Mile Creek Watershed District has reviewed the plans and grading and land alteration permit application for the expansion of the Super Valu Truck Maintenance Facility in Hopkins. The District reviewed and approved the overall development plan for this project in August, 1981. The original plans indicated an encroachment into the 100 year frequency floodplain of Nine Mile Creek, that was consistent with the District's floodplain encroachment criteria. The plans also indicated the construction of maintenance buildings within the floodplain of the creek with the buildings being flood - proofed. Restrictive covenants regarding the encroachment and the construction of buildings within the floodplain on this parcel were placed on the title to this property. The revised plans submitted, dated May 18, 1987, show a future encroachment into the floodplain of Nine Mile Creek and the buildings have been raised so that where surface water could enter the structures, the low point is at or above the 100 year frequency flood elevation. Our calculations indicate that this increased encroachment is. consistent with the District's floodplain encroachment criteria; however, no further fill or encroachment will be allowed for future development. The existing restrictive covenant must be amended to reflect that no further fill or encroachment will be allowed on this site for future development. With this noted, the Managers approve the grading and land alteration permit subject to the following conditions: 1. Erosion control measures must be installed encircling all existing storm water inlets within prior to commencement of grading operations and be maintained until all areas altered on the site have been restored. 2. All areas altered because of construction must be restored with seed and disced mulch, sod, wood fiber blanket, or be hard surfaced within 2 weeks after completion of construction or no later than October 15, 1987. • Mr. David Linner May 22, 1987 Page 2 3. Prior to commencement of construction, the existing restrictive covenant placed on the title to this project must be amended to state that no further fill or encroachment within the floodplain on this site will be allowed for future development. This amended covenant must be submitted to the District's legal advisor for review and approval prior to the commencement of grading operations.
