CONDITIONAL USE PERMIT - 241 5TH AVENUE NORTH

PLANNING COMMISSION
REPORT NO. CUP87 -20 JULY 20, 1987
PURPOSE: To review and recommend action on an
application for a Conditional Use Permit to construct
an addition to the existing building.
BACKGROUND:
Name of Applicant: Zion Lutheran Church
Address of Property: 241 5th Avenue North
Present Zoning: R -1 -C
Reason for Request: To construct a classroom
addition
Nature of Request: Ordinance requires a
Conditional Use Permit for construction over
$75,000.
Ordinance 525.13(0) states: "the building permit
requested is for new construction or for the
enlargement, remodeling or repair of the exterior of
any existing building including structures accessory
thereto, at a cost of at least $75,000 except one
through four family structures".
On February 3 the applicant was granted variances to
construct the classroom additions. A 13 foot front
yard variance and a 10 foot side yard variance was
granted. At that time the applicant was proposing
classroom additions on the west side and an office
addition on the east side. At this time the applicant
is only proposing to construct the classroom addition.
The applicant does not know when the other area will be
constructed.
The classroom addition will be located on the northwest
part of the site. The proposed addition will wrap
around the existing structure. The church with the
addition will be below the maximum lot area coverage of
35 %.

The exterior of the addition will match the existing
building on the north, west, and part of the side. The
south wall on the south interior of the site will be
finished with a cenentitious exterior finish. This
material is a stucco type material. This type of
exterior is proposed because of the possible future
expansion in the middle of the church.
The Fire Marshal has reviewed the plans and found them
acceptable.
The Director of Engineering has reviewed the plans and
found them acceptable. A new catch basin will be added
from the interior of the site to the corner.
No additional parking will be required since the
parking requirement is based on seating in the main
assembly hall. To the staffs knowledge, the church
does not have a parking problem.
The proposed plan shows a pedestrian drop -off along
Minnetonka Mills Road. The Director of Engineering has
found this acceptable. A new sidewalk will be added
with the pedestrian drop -off.
The applicant has an illegal sign in the landscaping on
the corner. The sign consists of a wood boarder with
the name of the church filled in with flowers. 570.25
Prohibited Signs: "signs painted, attached or in any
other manner affixed to trees, rocks, or similar
natural surfaces, or attached to public utility poles,
bridges, towers, or similar public structres ". This
sign has never received a sign permit. Any approval
should be contingent on the removal of the sign.
Landscaping will be added along the west and south
sides of the new addition. The proposed plan shows
three trees on the west side and two trees on the south
side. This will meet the landscaping requirement for
the new building, but the staff would recommend
additional landscaping.
The proposed addition is 35 and 19 feet in height. The
existing building that the addition will be added to is
19 feet in height.
The applicant is adding additional needed classrooms at
the most logical location. The variances granted in
February make it possible for the applicant to
construct the addition.

ALTERNATIVES:
1. Approve the Conditional Use Permit
2. Deny the Conditional Use Permit
3. Continue for further information
RECOMMENDATION: I recommend Alternative #1. The
following are suggested Findings of Fact and Conditions
should the Commission recommend approval:

an R -1 -C District.
L/2. That a church is a permitted use in an R -1 -C
District.
Conditions:
1. That the a3�-aign is removed.
2. That additional landscaping is added.
