Cond. Use Permit-St. TheresePLANNING COMMISSION REPORT NO: CUP87 -25 Planning Commission Report -, CONDITIONAL USE PERMIT - ST. THERESE SEPTEMBER 21, 1987 PURPOSE: To review and recommend action on an application for a Conditional Use Permit for a lesser setback and a larger sign than allowed. BACKGROUND: Name of Applicant: St. Therese Care Center Address of Property: 1011 Felti Court Present Zoning: R -4 Nature of Request: A 13.35 square foot sign with a 10 foot westerly setback and a 10 foot southerly setback., Reason for Request: To assure signage the elderly can see and to assure that the elderly have a good sight line. The applicant, St. Therese, will soon be completing their residential complex in south Hopkins. They are requesting two Conditional Use Permits: one to allow a larger sign than permitted and a second to place the sign in a lesser setback. Ordinance 570.48 states: "Conditional Use Permit R- districts. Signs may be permitted by Conditional Use Permit for public parks and playgrounds, churches, synagogues, public libraries, public museums, public and parochial schools, municipal buildings, golf courses, country clubs, community centers, colleges, universities and private schools, hospitals and sanitariums, based on the following design criteria and other conditions the City Council may require: a) size: The size shall be proportional to the size of the facility, need for signage, frontage on street(s), location, visibility, and development in the area. The maximum size should not exceed 60 square feet per sign surface with a maximum area of 120 square feet per single sign. No. CUP87 -25 Page 2 b) height: No free standing sign shall exceed fifteen feet in height. 0) lighting: 1. lighting shall be indirect or it shall be backlighting 2. neon lighting, flashing lighting, and /or rotating lighting sign shall be prohibited. d) design: signs attached to the building shall be integrated with the building design and architecture in terms of materials, colors, lighting and placement; signs not attached to the buildings shall be architecturally treated and coordinated with the principal building by use of compatible materials and design. e) location: no freestanding signs shall be located less than 25 feet from any street right - of -way line. f) sign purpose: the principal purpose of the sign permitted under this section shall be to identify the public or institutional use made of the property." Ordinance 570.47 states: "Conditional Use Permit. Applications for other proposed sign permits involving a lesser setback than that required by the zoning code may be granted only by and under a Conditional Use Permit and under the applicable provisions and regulations of conditional use requirements set forth in the zoning code. The Conditional use permits may require periodic reviews and may be canceled for cause ". The applicants proposed sign is 13.35 square feet. The maximum size requirement is 12 square feet, but with a conditional use permit a 60 square foot sign is allowed. The applicant is proposing to locate the sign 10 feet from the west and south property line on the northeast corner of Feltl Court and Smetana Drive. Ordinance 520.11 states: Traffic visibility. On corner lots in all districts except CUP87 -25 Page 3 B -2 and B -3, no structure or planting in excess of 30 inches above the abutting curb line shall be permitted within a triangular area defined as follows: "beginning at the intersection of the projected curb lines of two intersecting streets, thence 30 feet along one curb line, thence diagonally to a point 30 feet from the point of beginning on the other curb line, thence to the point of beginning ". The sign will not be in this area. The proposed sign will be shaped in a 'V'. The sign is supported by a brick base, one foot high. There will be brick columns on the sides of the sign. These columns are 3'8" high and 1 foot in width. The face of the sign will be made out of metal. The face will be painted dark green with white letters. The sign is lit from a source in the ground. ANALYSIS: The applicant is requesting a larger sign and a lesser setback. A sign up to 60 square feet is allowed with a Conditional Use Permit. In the past the Council has granted a Conditional Use Permit for larger signs than allowed by ordinance. The applicant has a large site which will accommodate a larger sign. The applicant has stated the reason for the larger sign is for greater visibility for the elderly. The applicant is requesting place the sign with a 10 foot setback from Smetana Road and a 10 foot setback from Feltl Court. The Director of Engineering has reviewed the placement of the sign and recommended at least a 10 foot setback on the southerly lot line along Smetana Road. A car coming from`Feltl Court to Smetana Road would not have a clear sight line down Smetana Road if the sign was located . in the proposed location. ALTERNATIVES: 1. Approve both conditional use permits as requested. This alternative could allow the applicant a larger sign and also a reasonable setback area for traffic visibility. 2. Approve the conditional use permit for a larger sign. This alternative would allow a larger sign and allow a better sight line to Smetana Road. • CUP87 -25 Page 4 3. Approve the conditional use permit for a lesser setback. This alternative could create a traffic hazard because of limiting the sight line to Smetana Road. 4. Deny both conditional use permits. This alternative would allow the applicant a 12 square foot sign with the proper setback. 5. Continue for further information. RECOMMENDATION: I recommend Alternative No. 1, approving the Conditional Use Permit for the following: - 13.35 square foot sign - a 10 foot southerly side yard setback - a 10 foot setback on the west The following are suggested Findings of Fact and Conditions should the Commission recommend approval: 1. That the size of the sign is in proportion to the size of the lot. Conditions: 1. A 10 foot setback is required from Smetana Road.
