Variance-Auto RepairPLANNING COMMISSION REPORT NO: VN87 -10 City Council Report VARIANCES - AUTO REPAIR 630 11th Avenue South OCTOBER 20, 1987 PURPOSE: To review and recommend action on an application for front and sideyard setback variances. BACKGROUND: Name of Application: Dale Feste Address of Property: 630 11th Avenue South Present Zoning: I -1 Nature of Request: A 10 foot northerly sideyard and a 6 foot front yard setback variance. Reason for Request: Space is needed for storage and auxiliary activities. These variances are in conjunction with the request for a Conditional Use Permit to construct an auto repair facility. The applicant is requesting two variances. A 10 foot sideyard variance on the north side and a 6 foot front yard variance. The applicant has stated that the side yard variance is needed for more space for storage, equipment, tools, and auxiliary activities. The front yard variance is needed for the ; "bay window" effect. ANALYSIS: Ordinance 525.07(3) states: "Findings; issuance of variance. Prior to the board formulating a decision and the conditions in support thereof, it must find that the literal enforcement of the provisions of the zoning ordinance would cause an undue hardship because of circumstances unique to the individual property under consideration, and that the granting of a variance to the extent necessary to compensate for said hardship is in keeping with the intent of this code." No. The applicant does not possess the required hardship to approve the variances. The building can be built smaller and the applicant can still conduct business. The applicant can have reasonable use of the property with the minimum setbacks. ALTERNATIVES: 1. Approve both variances. If the Commission chooses this alternative they will have to make Findings of Fact. 2. Approve the sideyard variance. 3. Approve the front yard variance. 4 +. Deny the variances. This alternative will make the applicant move the building to comply with the setback requirements. RECOMMENDATION: I recommend Alternative #4. The following are suggested Findings of Fact and Conditions should the Commission recommend denial: 1. That there are no warrants presented by the applicant in regard to hardship or unique circumstances justifying the requested variance. 2. Hardship to the applicant is the crucial test. Variances will be granted only in unusual situations which were not foreseen when the Zoning Ordin- ance was adopted. Economic situations are seldom unique and are rarely considered a valid hardship. Hardship A. Explain why strict enforcement of the Zoning Ordinance would cause undue hardship: Enforcement of the 20 foot side yard building setback requirement would substantially reduce the gross building area displacing the required space needed for storage, equipment, tools, and auxiliary activities_ The architectural hay window' effect cannot hp achieved within the required front yard setback without critically reducing the office width. Conditions 6. What are the special conditions (shape of lot, exceptional topographic conditions, etc.) of this request that are unique to this property and do not apply generally to other properties in the district?
