Use Permit-Oak Park Ln.Planning Commission Report CONDITIONAL USE PERMIT- OAK PARK LANE PLANNING COMMISSION REPORT NO: CUP87 -12 NOVEMBER 16, 1987 PURPOSE: To review and recommend action on an application for a Conditional Use Permit to construct townhomes in a PUD. BACKGROUND: Name of Applicant: Mark Eklo Address of Property: Oak Park Lane Present Zoning: R -2 Nature of Request: Ordinance requires a Conditional Use Permit for construction over $75,000 and a PUD. Reason for Request: To construct 7 townhomes. The applicant is proposing to build 7 owner occupied townhomes. Townhomes are a permitted use in an R -2 District. 525.13 states that a Conditional Use Permit is required for new construction or for the enlargement, remodeling or repair of the exterior of any existing building including structures accessory thereto, at a cost of at least $75,000 except one through four family structures. The subject site is located off Oak Park Lane between Tyler and Van Buren. Access to the site will be from Oak Park Lane. The site is surrounded by single family, duplex and multiple family residential units. R -2 Proposed Townhomes Lot Area 12,000 Approx. 34,714 Lot Area /Family 3,500 Approx. 4,959 Lot Width 100 132.23 Bldg. Building Height R -2 Proposed Townhomes 72 1 , 1 52 32 All the units will be two story - two bedroom units with approximately 1,152 square feet. The Comprehensive Plan has designated this area R -1- A,B. The applicant is required to have 12 trees. The landscape plan submitted fulfills this requirement. The applicant has designed the townhomes with the idea that at some future date a road could be extended to the south. Jackson Avenue to the west was done in this manner. In order to have the sites front yard on the east side of the property, the applicant will have to dedicate the road on the east side of the property. Drainage will flow in a southerly direction. The Director of Engineering has reviewed the plan and found it acceptable. The Director Engineering also noted that the applicant will have to get permission from the abutting property to hook up to their water and sewer. All the units will have a.4 -oublc dctao - hed garage. This will fulfill the parking requirements. The units will be staggered both in elevation and horizontally to prevent a row -type appearance. The applicant has stated he plans to subdivide the property after the townhomes are built. At this point this development is a P.U.D. The applicant will not be able to subdivide the lot. At the time of this report the applicant did not know the colors of the townhomes. The exterior will have siding with brick on the bottom. The roofs will be shingled. CUP87 -12 Page 3 ALTERNATIVES: 1. Approve the plan as proposed. This will enable the applicant to construct the townhomes as presented. 2. Deny the plan as proposed. If this alternative is chosen the Commission will have to formulate findings of fact. 3. Continue for further information. If the Commission feels that further information is needed, this item should be continued for a month. RECOMMENDATION: I recommend approving the Conditional Use Permit to construct 7 townhomes. The following are suggested Findings of Fact and Conditions - should the Commission recommend approval: 1. The proposed townhomes meet the requirements for an R -2 District. 2. The proposed townhomes meet the requirements for a Conditional Use Permit. 3. The proposed townhomes meet the requirements for a P.U.D. Conditions: 1. That the applicant meet the requirements of the Fire Marshal. 2. That the applicant dedicate the road on the east side of the property.
