VARIANCE REQUEST - PAUL STEIMER
708 - 12th Avenue South
NOVEMBER 16, 1987
PROPOSED ACTION: Staff recommends - adoption of the following
motion The request by Paul Steiner for a 9 foot rear yard
setback variance is denied.
Adoption of this motion will require the applicant to reduce
the size of the southerly storage units or re- orient the
structures on the lot to accommodate the required 20 foot
setback.
OVERVIEW: The applicant is proposing a mini- storage
development. He has also applied for rezoning and a
Conditional Use Permit. The ordinance requires a rear yard
setback of 20 feet in an I -1 District. The proposed plan
shows a setback of 11'4 ".

Nature of Request: To reduce he southerly
yard setback from 20 feet to 9 feet
Issues to consider: Does the applicant posses a hardship
unique to the property for justification of a rear yard
setback variance?

The subject lot does have some soil problems, but they are
correctable. Some of the poor soil is in the rear of the
site is the place the southerly building will be built. The
applicant is not requesting to move away from the poor soil,
but on top of it. The soil problems are correctable.
The property adjacent to the rear of the site is vacant.
This property was used to reduce the density of the Patio
Homes, so it will remain vacant.
The applicant is requesting this variance because
economically the development does not work without the
southerly building. Economic considerations alone do not
justify a variance.
The property does not posses any unique situation to justify
the granting of a variance. The staff feels the project can
be done without a variance.
ALTERNATIVES /EFFECTS:
1. Approve the 9 foot rear yard setback. With this
alternative the Commission will have to
formulate Findings of Fact which justify the
granting of the variance.
2. Deny the 9 foot rear yard setback variance. The
applicant will have to reduce the southerly
storage units or re- orient the units to
accommodate the required setback.
3. Continue for further information. If the
Commission feels they need more information, the
application should be continued for another
month.
FINDINGS OF FACT:
1. That there does not exist a unique circumstance
or hardship that would justify approval of this
variance.
2. That the subject property's use is not
restricted because of the 20 foot rear yard.
