11-24-1987• • A regular meeting of the Hopkins Zoning and Planning Commission was held in the Council Chambers of the City . Hall on Tuesday, November 24, 1987, at 7:30 p.m. Present were Chairman E. Anderson, members R. Anderson, Denny, Ebel, Maxwell and Richardson. Also present was Nancy Anderson, Community Development Analyst. ITEM: Meeting was called to order by Chairman Anderson at 7:35 p.m. Mr. Denny moved and Mr. Maxwell seconded a motion that the minutes of the October 27, 1987 meeting be approved and signed. Motion carried unanimously. CASE NO: VN87 -8 CLAUDE BLACK (5 -8) Hearing to consider an application by Claude H. Black for a 5 foot side yard variance to construct an addition to the building at 620 12th Avenue South, continued from the October 27, 1987 meeting. CASE NO: CUP87 -23 CLAUDE BLACK Hearing to consider an application by Claude H. Black for a Conditional Use Permit to construct an addition to the building at 620 - 12th Avenue South, continued from the October 27, 1987 meeting. Mr. Denny moved and Ms. Richardson seconded a motion that the two hearings be tabled at the request of the applicant. Motion carried unanimously. CASE NO: CUP87 -27 DALE FESTE (8 -42) Hearing to consider an application by Dale Feste for a Conditional Use Permit to construct an auto repair facility at 630 - 11th Avenue South continued from the October 27, 1987 meeting. Mr. Feste and Mr. Fechtel were present to explain the request. Mr. Feste stated that he had met with the adjoining property owner and that he was in agreement with building constructed to the lot line. The City Attorney's opinion stated that Mr. Feste can build his building to the lot line. No one present in opposition to the proposal. Mr. Denny moved and Mr. Maxwell seconded a motion recommending to the Council approval of the Conditional Use Permit with the Findings of Fact: 1. That an auto repair facility is a permitted use in an I -1 District; 2. That the proposed plan with changes will meet the requirements for an I -1 District; 3. That the proposed plan meets the requirements for a Conditional Use Permit; and with the Conditions: 1. That an easement for maintenance between both property owners be obtained and filed with the City; 2. That the building be sprinkled. Motion carried unanimously. Request by Mark Eklo that Conditional Use Permit CUP87 -12 be removed from the table. Ms. Richardson moved and Mr. Denny seconded a motion that the Hearing be removed from the table. Motion carried unanimously. Planning Commission Minutes of 11 -24 -87 page 2 CASE NO: CUP87 -12 MARK EKLO (45 -128) Hearing to consider an application by Mark Eklo for a Conditional Use Permit to construct seven townhomes on Oak Park Lane. Mr. Eklo and Mr. Carlson, appeared before the Commission. Mr. Eklo had a request before the Commission in the spring of 1987 but was unable to satisfy the Fire Marshal's requirements for a turn - a -round to accommodate City fire equipment. The new design presented does meeting the Fire Marshal requirements. Mr. Tim Mullen, property owner at 301 Van Buren North, was concerned about drainage from the site. Mr. Eklo stated that the site would remain at approximately the same elevation as presently exists. Mr. Eklo also stated that he would be willing to consult with an engineer before appearing before the Council to provide more detailed information. Ms. Richardson moved and Mr. Denny seconded a motion recommending to the Council approval of the Conditional Use Permit to construct seven townhomes on Oak Park Lane with the Findings of Fact: 1. The proposed townhomes meet the requirement for an R -2 District; 2. The proposed townhomes meet the requirements for a Conditional Use Permit; 3. The proposed townhomes meet the requirements for a P.U.D.; and with the Conditions: 1. That the applicant meet the requirements of the Fire Marshal; 2. That the applicant dedicate the road on the east side of the property; 3. Drainage be resolved to the satisfaction of the Council. Motion carried unanimously. CASE NO: ZN87 -3 PAUL STEINER (129 -349) Hearing to consider an application by Paul Steiner for rezoning the property located at 708 - 12th Avenue South from B -3 Business to I -1 Industrial. CASE NO: VN87 -11 PAUL STEINER Hearing to consider an application by Paul Steiner for a 10 foot rear yard setback variance to allow construction of a mini storage facility at 708 - 12th Avenue South CASE NO: CUP87 -28 PAUL STEINER Hearing to consider an application by Paul Steiner for a Conditional Use Permit to construct a mini storage facility at 708 - 12th Avenue South. Mr. Paul Steiner and Mr. Don Hustad reviewed the requests with the Commission. Mr. Steiner stated that the requests were based on the fact that the mini storage facility could not be constructed in a B -3 District; the variance was requested due to some soil problems, and the property to the south is vacant and cannot be built on. Also the development does not work economically without the southerly building; and a Conditional Use Permit is required for construction over $75,000. Mr. Steiner also spoke in regard to the staff findings concerning the use of brick on the north side of the building. He stated that it is too costly to face the building with brick. He also stated that almost all storage buildings are constructed without sprinklers. No one was present in opposition to the proposal. Planning Commission Minutes of 11 -24 -87 page 3 ITEM: ATTEST: The Commission expressed a desire to see a sample of the construction block. They also had concern regarding the sprinkling of the building in regard to the City Code. Also there was no ,justification for a variance. Mr. Steiner stated that he has been in contact with Mr. Neslund, owner of the property to the south. Mr. Steiner stated that he may purchase the vacant land to the south or Mr. Neslund may purchase Mr. Steiner's property if the project is not constructed. If the vacant land were purchased, a variance would not be needed. Mr. Denny moved and Mrs. Ebel seconded a motion that the hearings be continued to the December 29, 1987 meeting, giving Mr. Steiner time to resolve the variance concern, and to have a sample of the construction material for the Commission to view. Motion carried unanimously. HEARING: COMPREHENSIVE PLAN (350 -353) Hearing to amend the Comprehensive Plan from R -2,3 to I -1 Industrial, the property located at 708 - 12th Avenue South to bring the zoning and Comprehensive plan into conformance. Ms. Richardson moved and Mr. Maxwell seconded a motion to continue this hearing until December 29, 1987 due to the action on Mr. Steiner's requests. Motion carried unanimously.
