08-25-1987A regular meeting of the Hopkins Zoning and Planning
Commission was held on Tuesday, August 25, 1987, at 7:30
p.m., in the Council Chambers of the City Hall.
Present were members R. Anderson, Brandon, Denny, and
Richardson. Also present were Community Development
Director Mielke, Planning & Economic Development Director
Kerrigan, and Community Development Analyst Anderson.
In the absence of Chairman E.Anderson, Mrs. Brandon chaired
the meeting.
ITEM: (3 -6)
Mr. R. Anderson moved and Mr. Denny seconded a
motion that the minutes of the July 28, 1987
meeting be approved and signed. Motion carried
unanimously.
CASE NO: CUP85 -51 (9 -81)
Hearing to consider an application by Mizpah United
Church of Christ for a Conditional Use Permit to
construct an addition to the west side of the
existing church at 412 Fifth Avenue North. Hearing
previously tabled at the request of the applicant
October 29, 1985.
Mr. Paul Snyder of Armstrong, Torseth, Skold &
Rydeen and Mr. John Glasgow, representing Mizpah
Church, reviewed the the plans with the Commission.
They stated that there would be no additional
seating and that the parking area will remain the
same. The addition is to provide for better
internal circulation and handicap access. Their
plans also include an elevator shaft and hopefully
they will have enough money for an elevator.
No one appeared in opposition to the proposed
project.
Mr. R. Anderson moved and Ms. Richardson seconded a
motion recommending to the Council approval of the
Conditional Use Permit for an addition to the west
side of Mizpah Church with the Findings of Fact: 1.
That a church is a permitted use in an R -4
District; 2. That the addition meets the
requirements for an R -4 District. Motion carried
unanimously.
CASE NO: CUP87 -21 (84 -116)
Hearing to consider an application by Kathy McGee
for a Conditional Use Permit to operate a Day Care
in her home at 1301 Highway No.7 #105.
Ms. McGee appeared before the Commission and stated
that she cares for seven children at the present
time, one of which is her own. She stated that her
building is situated so that the children have a
play area that is enclosed by buildings. She also
stated that she has had day care in her home for
one year.
It was noted that the Fire Marshal has inspected
her home and approved her for six children. If the
applicant wants day care for over six children it
must be inspected by the Building Inspector and
meet the Building Code.

Mr. Denny moved and Mr. R. Anderson seconded a
motion recommending to the Council approval of the
Conditional Use Permit for Day Care at 1301 Highway
No. 7 #105, with the Findings of Fact: 1. That a
day care is a permitted use in an R -4 District; and
with the Conditions: 1. That the Fire Marshal
inspect the home, 2. That the applicant is licensed
by the County. Motion carried unanimously.
CASE NO: CUP87 -22 (118 -675)
Hearing to consider an application by Dick Hughes
Inc. Towing and Starting, for a Conditional Use
Permit for an impound lot at approximately 900
Second Street N.E. (a portion of the Massey -
Ferguson property).
Mr. Hughes appeared before the Commission. He
stated that he presently has the towing contract
with the City and leases land from the City on the
former landfill site. His lease will not be
renewed due to possible development of the landfill
site. He stated that the debris that is on the
leased site is not from his towing business but
from tenants he has sharing the lot with him. He
does no dismanteling or repair of cars on his site.
Mr. Hughes stated he will move a new mobile home on
the site which will meet all the building code
requirements. There is a person on duty 24 hours a
day, with the exception that this person may leave
for a short period of time for a night pall. He
would like to have lights on the lot which would
face away from the street into the lot. He also
stated that another fence will be added behind the
existing fence to allow for the 50 foot setback.
The Commission stated concern about increased
traffic in the area. Mr. Hughes stated that they
tow about 10 cars a day and many of those are towed
at night.
Staff stated concern with this type of use in this
area and are against the proposal.
Ms. Richardson moved and Mr. Denny seconded a
motion to continue the hearing to the next meeting
and require the applicant to: 1. Meet with the
surrounding owners and tenants, 2. Prepare a
landscape plan for the 50 foot setback, 3. Prepare
a surface plan for the 80,000 square feet in
asphalt, concrete or another alternative, 4. Plan
for an opque type fence. Ms. Richardson and Mr.
Denny voting yea; Mrs. Brandon and Mr. R. Anderson
voted nay. Tie vote. Item forwarded to Council
with no recommendations or findings of fact.

Hearing to consider an application by Claude H.
Black for a 5 foot side yard variance to construct
an addition to the building at 620 12th Avenue
South.
Hearing continued to the September 29, 1987 meeting
at the request of the applicant.
