PURPOSE: To review and recommend action on a waiver of the platting requirements
to divide the lot at 921 Mainstreet.

The applicant is proposing to divide a single parcel of land into two separate
parcels at the current site of Preferred Travel. The applicant was approved
for a Conditional Use Permit for construction on this site and the adjoining
property and a variance to locate the building one foot from the lot line at the
trash dumpster. A B -2 district does not have a minimum lot area, however, there
is a minimum lot width of 20 feet, which both lots will have. The applicant will
have access to the subject property from the alley.
It has been usual policy for the Commission to grant a waiver of the plat on a
single division provided the lots created are legal and with approval contingent
upon acceptance by Hennepin County Recorder of the division.
ANALYSIS: The applicant has requested a waiver of the plat to construct a building
in conjunction with the building on the adjacent lot. The proposed lots will com-
ply with the minimum lot requirements for a B -2 district.
RECOMMENDATION: I recommend approval of the waiver of the platting requirements
based on the fact that two conforming lots will be created. The following findings
of fact are suggested should the commission recommend approval:

Since the rezoning of this site (Berglund & Johnson parcel) was
denied on October 29, 1985, the Comprehensive Plan needs to be changed
to reflect conformance with the Zoning and Comprehensive Plan. Currently
the Comprehensive Plan designation is B -2, B- 3 /I -1, while it is zoned
R-6.

The Zoning and Planning Commission of the City of Hopkins will hold a
public hearing on Tuesday, January 28, 1986, at 7:30 p.m., in the Council
Chambers of the City Hall to consider a Comprehensive Plan change for the
following described property from B -2, B -3, Business and I -1 Industrial to
R -6 Residential:

except road, Section 25, Township 117, Range 22, according
to the plat thereof on file or of r -cord in the office of
the Register of Deeds in and for Hennepin County.
