WVR86 -2 Name of Applicant: Address of Property: Present Zoning: Reason for Request: 4)0m tcl 0 Nancy S Anderson Communi y Development Analyst WAIVER OF PLATTING REQUIREMENTS BELLGROVE AREA CITY OF HOPKINS JANUARY 16, 1986 PURPOSE: To review and recommend action on a Waiver of Platting Requirements to divide the lot at One Loring Road BACKGROUND: Nature of Request: To divide a single lot of 66,752 square feet into two lots of 36,315 square feet and 30,447 square feet. Marvel Eggum One Loring Road R -1 -D Higher tax base and better land use. The subject property is zoned R -1 -D which requires 20,000 square feet of lot area. The easterly most lot of the division would contain 36,315 square feet and a westerly lot of 30,447 square feet. The proposed lot would have a front- age of 220 feet on Minnetonka Boulevard. The applicant is proposing to have access to the proposed lot on Minnetonka Boulevard, however, if access is not granted from the County, access will be from Loring Road. If access is granted on Minnetonka Boulevard, the strip of land to Loring Road will become a utility easement. The City Engineer has noted that there will be a sewer and water connection charge. A similar division was approved by the Zoning and Planning Commission in April 1985 at 6 East St. Albans Road. It has been standard policy for the Commission to grant a waiver of the plat on a single division provided the lots created are legal and with approval contingent upon acceptance by Hennepin County Recorder of the division. ANALYSIS: The applicant has requested a waiver of the plat in order to construct a single family home. The proposed lots will comply with the minimum lot require- ments. A single family dwelling is the only permitted use with the exception of a park in an R -1 -D district. RECOMMENDATION: I recommend approval of the waiver of the platting requirements based on the fact that two conforming lots will be created. The following find- ings of fact are suggested should the commission recommend approval: Resolution recommending approval 1. That the waiver of the plat will form two conforming lots 2. That a single family dwelling may be built on the proposed lot 3. That the proposed lots conform to all requirements of the City's zoning ordinances. p) N S
