Name of Applicant: James Marvy Address of Property 37 -41 12th Avenue North Present Zoning: R -4 Nature of Request: Construction over $75,000 requires a Conditional Use Permit. Reason for Request: To construct an addition for storage The applicant is proposing to construct a 835 square foot addition between the two existing buildings. This addition will primarily be used for stor- age. 427.33(u) allows photographic illustration studios in the 'R -4' and 'R -5' Districts. The applicant has applied for a variance to exceed the building coverage. R -4 Requirements Site This site is legal non - conforming, the existing setbacks will remain and are grandfathered in, also while the applicant does not meet the parking requirements this is also grandfathered in and remains the same since the proposed addition will be used for storage. The proposed addition will have an exterior to match the existing church. The trash container is located at the northeast corner of the site. The Director of Engineering has the drainage plan, and has found it accept- able. The applicant is required to have 10 trees on site to meet the landscaping • REPORT N0. CUP86 -5 Page 2 ordinance. With the existing and proposed trees, the applicant exceeds this requirement. The Fire Marshal has reviewed the plans and found them acceptable at this time. ANALYSIS: The proposed building will be used for storage hence the site will not be intensified by the addition nor will tiy new employees be added. The exist- ing buildings do not have the required setbacks, however, these setbacks will not be affected nor will the parking requirements. In reality the intensity and use of the site will remain the same, the only change will be the applicant will have more storage room. RECOMMENDATION: I recommend approval of the Conditional Use Permit. The following are suggested Findings of Fact should the Commission recommend approval: 1. The proposed addition meets the requirements for a Conditional Use Permit. 2. The proposed addition meets the requirements for the R -4 District. Also with the following Conditions: 1.
