The following proposed language would cover expansion of non- conform-
ing buildings and lots providing that it is a lawful use in that district.
427.06
(10) A non - conforming use shall not be extended but the
extension of a lawful use to any portion of a non-
conforming building shall not be deemed the exten-
sion of such non- conforming use, if such extension
meetsall other provisions of this ordinance.
(11) An existing conforming..u.won lot of substandard
size may be expanded or enlarged if such expansion
or enlargement meets all other provisions of this
ordinance.
A lawful use in any district is a use that is permitted in that
district. An example of a use that would not be lawful but is grandfathered
in would be an auto repair shop located in a residential district. This would
be a non-conforming use and would not be able to expand. A lawful use would be
a single family home in a R -1 district.
