Nature of Request: Ordinance requires a
Conditional Use Permit for 6 -11 children.
Reason for Request: To permit day
care for 6 -11 children.
The applicant is proposing to have a day care for
children in her home for 11 children. The subject home
is a duplex. A day care within an R -2 district is a
conditional use. 427.33 (2)(k) states within "R -2 ",
"R -3 ", "R -4 ", "R -5 ", and "R -6" Districts, day care for
more than five and less than eleven children is allowed
provided such premises are licensed therefor by the
State of Minnesota.
ANALYSIS:
The applicant lives within the correct zoning district
to allow up to 11 children with a Conditional Use
Permit. The only other stipulation in the Zoning
Ordinance is that the applicant is to be licensed by
the State.
A problem that mightoccur with this number of children
is that the children may tend to play throughout the
neighborhood. If this becomes a problem, the
Commission may want a Condition on the Conditional Use
Permit that the yard be fenced.
RECOMMENDATION:
I recommend approval of the Conditional Use Permit.
