PURPOSE: The purpose of this report is to review and
recommend action on a Conditional Use Permit to
construct an office building.
BACKGROUND:
Planning Commission Report

Present Zoning: B -1
Reason for Request: To construct a 14,500
square foot office building.
Nature of Request: Ordinance requires a
Conditional Use Permit for construction over
*75,000.
The applicant is proposing to construct a 14,500 square
foot building on the empty lot just north of the
present site of the Warrington building at 601 2nd
Avenue South. 427.26 (c) requires a Conditonal Use
Permit for construction valued over *75,000.
The proposed building will also be connected to the
present Warrington building by a link. The applicant
has applied for a side yard variance.

The applicant is required to have 25 trees. The
applicant is proposing to have 31 trees of various
types. The applicant will also be retaining many of
the existing trees on the site.
Access to the site will be from 2nd Avenue at the north
end of the site. The parking area will be connected to
the building by a 5 foot concrete walk.
The applicant will contact the Watershed District and
obtain approval if necessary.
The exterior of the building will be brick.
The applicant has contacted the neighborhood
organization.
The Director of Engineering has reviewed the drainage,
as of the date of this report and saw no problems with
the plan.
The Fire Marshal has reviewed the plans and noted that
a fire door will have to be constructed in the link,
however, the final placement will be done at the
building permit stage.
The applicant may in the future construct another
building to the north of this building, however, at
that time the applicant will have to apply for another
Conditional Use Permit and have the development
reviewed at that time.
The applicant has not detailed the lighting for the
parking area, however the lighting will have to conform
to 427.44 which requires the lighting to be shaded or
diffused from the adjoining property and away from
abutting traffic.
ANALYSIS: The proposed building meets the requirements
for the B -1 District with the exception of the link to
the existing building. However, if this link is removed
the proposed building could exist independently and
conform to the ordinance. The heights of the buildings
along Second Avenue has been a concern of the abutting
neighborhood, however, with the proposed elevations
this building will be lower than the present Warrington
Building. The applicant is proposing to leave many of

the existing trees which will also minimize the impact
to the surrounding area.
RECOMMENDATION: I recommend approval of the
Conditional Use Permit. The following are suggested
Findings of Fact should the Commission recommend
approval:
1. The proposed building meets the requirements
for the B -1 District.
2. That the proposed building meets the
requirements for a Conditional Use Permit.
