11th Avenue South & County Road 3

PURPOSE: To review and recommend action on a rezoning
at County road 3 and 11th Avenue South.
BACKGROUND:
Name of Applicant: Midwest Auto Malls
Address of Property: Northeast corner of
11th Avenue South and County Road 3.
Present Zoning: B -2
Proposed Zoning: B -3
Nature of Request: Rezoning to allow auto
repair
Reason for Request: B -2 district does not
allow auto repair.
This rezoning is in conjunction with the Conditional.
Use Permit and street vacation request to construct an
Auto Mall.
The applicant is proposing to construct an Auto Mall at
the former site of White Motor office and CPT. The
present zoning is B -2, however this zoning does not
allow auto repair.
427.35 requires a minimum lot size of 3000 sq. ft. and
a lot width of 25 feet. The subject site meets the
minimum lot requirements for a B -3 district lot. The
site is surrounded by a B -2 district to the north, an
R -5 district to the west, a B -3 district to the south
and an I -1 district to the east. The Comprehensive
Plan designates this area as Central Business District.
ANALYSIS: This site is an excellent site for commercial
business because of the amount of traffic on County
Road 3 and 11th Avenue South.
The subject parcel is currently zoned B -2, however,
auto repair is not permitted. The type of auto repair
that is proposed is minor repair and will not consist
of junk cars and parts throughout the parking area.
The proposed businesses conduct minor repairs. In many
cases the customers will wait for their cars to be
finished. The proposed development is consistent with
the Comprehensive Plan.
ALTERNATIVES:
1. Approve the rezoning contingent upon the
applicant securing use of Second Street
South.
2. Disapprove the rezoning. If the
Commission takes this course of action, the
applicant will not be able to construct the
Auto Mall.
RECOMMENDATION: I recommend approval of the rezoning.
The following are suggested Findings of Fact and
Conditions should the Commission recommend approval:
1. The proposed use is consistent with the
surrounding uses.
2. That the subject lot meets the minimum
requirements for a B -3 District.
3. That the proposed zoning is consistent
with the Comprehensive Plan.
Conditions:
1. The applicant secures use or ownership of
Second Street South.
