VACATE ALLEY

PURPOSE: To review and recommend action on an application to
vacate an alley.
BACKGROUND:
Name of Applicant: Dennis Madden
Address of Property: Alley behind 13 - 8th Avenue
South
Present Zoning: B -3
Nature of Request: Vacation of the north -south
alley behind 13 - 8th Avenue South.
Reason for Request: To allow for a more efficient
use of parking, increase parking spaces and
improve traffic flow.
The applicant is requesting to vacate the alley that
currently divides the applicants parking lot from his
business. The area behind Bursch's is a paved parking lot
which is separated by the alley.
This alley serves the residents of the Hopkins Plaza by
providing an exit to 8th Avenue.
The only utility company responding to our notice was the
phone company who found it acceptable. There is also a
storm sewer in the alley.
ANALYSIS: This alley serves the Hopkins Plaza residents and
is also used for fire access. The vacation would limit the
residents to one access point and cut -off a portion of fire
access.
If the alley is vacated, the residents will have an
entrance /exit to 7th Avenue only. the residents currently
use the applicants southerly ingress for an entrance to 8th
Avenue, however, the residents are crossing private property
which could be blocked off to their use.
The Fire Marshal has reviewed the proposed plan and does not
want the alley adjacent to Hopkins Plaza vacated to allow
for the access of fire trucks.

Another course of action, instead of vacating the alley is
to allow the applicant to use it for parking without
vacating it. However this solution is not perfect because
if the alley is used for parking, access to the adjacent
apartments may be unaccessible because of• parked cars on the
alley.
Snow removal is also a concern. If the alley is vacated
snow removal from the apartments would be difficult.
Currently the snow can be either removed from 7th through
the alley or vice - versa. If the alley is vacated, the
access to the apartments will become a dead end, hence
making snow removal quite difficult.
ALTERNATIVES:
1. Vacate the alley
2. Vacate the alley, except the
to Hopkins Plaza
3. Deny the vacation and refer to
Attorney to draft an agreement to allow
to use the alley for parking.
4. Deny the vacation and leave the alley

RECOMMENDATION: I recommend denial of the vacation and
leaving the alley as is. The following are suggested
Findings of Fact should the Commission recommend denial:
1. That there is an access requirement for fire
trucks of 150 feet.
2. That the vacating of the alley would limit fire
access.
3. That access points to the adjacent apartments
will be limited to a one way.
