In response to the discussion of Home Occupations at the last Zoning
and Planning meeting, the staff was asked to look into several areas of concern.
The residence at 643 7th Avenue South was homesteaded as of January
1985 by Steven and Susan Klappa. On October 9, 1984 a letter was sent by Per. Craig
to the residence informing them that a complaint had been received about running a
body shop in their garage. The body operations have ceased as a result of the
letter.
The residence at 500 5th Avenue was homsteaded as of January 1985 by
Greg and Rhonda Smith. A concern of the Commission at the last meeting was the
parking of vehicles on the boulevard at this address. Section 700:169:34 Pro-
hibitions; Stopping Parking. States on a sidewalk; curbed or uncurbed boulevard
or public walkway.
A staff report is included that was done by Chief Earl Johnson on the
police activity at 537 5th Avenue South.

the city zoning law, as it pertains to home occupations. Since
the provisions of this ordinance are enforced by the Hennepin

SUBJECT: Enforcement at 537 5th Avenue South
BACKGRO
It is my understanding that the Duane Hartmann family has resided
at 537 5th Avenue South for approximately eight years.
During that time they have allowed their eldest son, Lee Hartmann,
to bring home old vehicles and repair them.
The officers report that he has purchased an old tow truck and
started bringing home junkers. Apparently he removes the usable
parts and sells the remains to junk yards.
Detective Earl Weckman indicated to me that he has over the last
eight years dealt with these people on many occasions. He has
provided them with copies of the ordinance pertaining to these
violations and has explained in detail to them the legal
requirements.
Detective Weckman states that following one of these conversations,
they erected a fence to keep the materials hidden from view.
Both parents and the son have been cited by Detective Weckman for
these violations.
In reviewing Officer Laun Anderson's report covering both the junk
car and sanitation officer duties, he has indicated that he has
issued approximately ten to twelve citations to vehicles parked at
this address. Unfortunately these citations are issued to the
license plate as per standard procedure. If these vehicles are not
registered in the name of the Hartmanns with the State Department
of Motor Vehicles, warrants will eventually be issued to the
registered owner of the vehicle. It is not possible to trace these
citations to receive a disposition.

It is interesting to note that during this past summer Detective
Weckman issued citations six days in a row for the same vehicles
that were parked illegally at the Hartmann residence. One of the
municipal judges that heard the case felt that this was
unreasonable and all but two of the tags were dismissed. This
obviously is extremely frustrating for the officers.

residence. Again on 12 -5 -84, another citation was issued to that
same vehicle. Both of these citations have been paid through
Hennepin County Court at Ridgedale.
On 12- 20 -84, another citation was issued to the tow truck for
Parking on a Boulevard. The disposition of this citation has not
yet cleared the court records.
CONCLUSION
It is readily apparent that the Hartmanns have received numerous
warnings from the police department which, when not complied with,
were followed up by the issuance of citations.
Occasionally the police department will find a violator who
continually disregards both the warning and the citations that
eventually follow. For some reason these individuals choose to
pay the fine and continue in violation of city ordinance. This
appears to be one of those instances.
The police department will continue to monitor and to take strict
enforcement action for any violations.

Dear Mr. Miller:
Being a new business person in Hopkins, I have become aware of
some images outsiders may have of this city. The first thing
that becomes apparent is the new access from County Road #18,
making it very accessable. From this main entry into the city,
could I suggest some aesthetic improvements along both sides of
Excelsior Boulevard, from #18 west to 10th Avenue;
Railroad property to be mowed, some hedges and shrubs, etc.
The north side owners to maintain their lawns and city to put in
shrubs and hedges where possible.
Can we make this street (Excelsior Blvd.) more of a groomed and
well cared for entrance to Hopkins. This is now our front door.
Business people and shoppers get first impressions driving down
that main entry, let's make it attractive. We have alot of
heavy competition from the other suburban communities, let's
"spruce" our town up.
Being a member of the "Main Street Committee ", I have, as'do the
other members, Hopkins in our best interest.
