Use Permit-Walser-Locate a Sign in a Lesser Setback• January 17, 1985 Case No: 85 -05 Applicant: Walser Corporation Location: 314 West Excelsior Avenue Request: Conditional Use Permit to locate a sign in a lesser setback STAFF FINDINGS & COMMENTS: Anderson 1. The applicant is requesting a Conditional Use Permit to locate a sign in a lesser setback than required. The subject site is located at 314 West Excelsior Avenue, the current site of Walser Chrysler Plymouth. The site is zoned B -3. 2. Ordinance 427.42(15) requires for other proposed sign permits not prohibited by Section No. 409 and involving a lesser setback than that required by the Hopkins Zoning Ordinance may be granted only by and under a Conditional Use Permit as defined in Section 427.04(26) and under the applicable provisions and regulations of Conditional Use requirements set forth in Section 427.26 of the Hopkins Zoning Ordinance which Conditional Use Permits may require periodic reviews and maybe cancelled for cause. • 3. Ordinance 427.35 requires a 10' setback for a side yard abutting a County Road in a B -3 District. The applicant is proposing to have the proposed sign abutt the property line. 4. The proposed sign was granted a variance to exceed the maximum allowable height at the October 30, 1984 meeting. 5. The proposed sign face has remained the same since approval of the variance. The sign will be 215 square feet per side and located on the east side of the subject site. It will be made of herculite and will be blue and white in color. The lighting will be indirect, internal floresent. 6. The applicant stated that this Conditional Use Permit is being requested because of an error in the location of the sign foundation for a flag mount sign. is • February 14, 1985 • Case No: 85 -06 Applicant: First Federal Savings Location: South of 690 16th Avenue South Request: Conditional Use Permit to construct fence STAFF FINDINGS & COMMENTS: 1. Applicant is requesting a Conditional Use Permit to construct a fence around a mobile home at a location south of 690 16th Avenue South. The subject site is zoned I -2. 2. Ordinance 427.11(8) requires fences for special purposes and fences differing in construction, height or length maybe permitted in any district in the City of Hopkins by the issuance of a Conditional Use Permit approved by the Zoning and Planning Commission and by the City Council upon proof and reasons submitted by the applicant and upon the signing by said bodies that such special purpose is necessary to protect, buffer or improve the premises for which such fence is intended. Such special fence permit, if issued, may stipulate and provide for the height, location, construction and type of special fence thereby permitted. 3. The fenced area will be approximately 40'x100'. The proposed fence will be six feet high and made of cyclone. 4. The applicant has stated that the fence will remain if the mobile home is sold and other repossessed items will be stored at the subject site. 5.
