Use Permit-Relocate Sign0 March 13, 1985 Case No: 85 -10 Applicant: Zion Lutheran Church Location: 241 5th Avenue North Request: Conditional Use Permit to relocate sign STAFF FINDINGS & COMMENTS: Anderson I. Applicant is requesting a Conditional Use Permit to locate a sign in a lesser setback than required and also to exceed the maximum area of a single sign. The subject site is located at 241 5th Avenue North and zoned R -1 -C. 2. Ordinance 427.42(A5) states that applications for other proposed sign permits not prohibited by -Section No. 409 and involving a lesser setback than that required by the Hopkins Zoning Ordinance may be granted only by and under a Conditional Use Permit as defined in Section 427.04(26) and under the appli- cable provisions and regulations of Conditional Use requirements set forth in Section 427.26 of the Hopkins Zoning Ordinance which Conditional Use Permits may require periodic reviews and maybe cancelled for cause. • 3. The applicant is proposing to locate a new sign approximately 39 feet north of the existing sign. The current and proposed signed will have the same setback of approximately 12 feet. Ordinance 427.31 requires a front yard setback of 30 feet in an R -1 -C district. 4. The proposed sign will be 8 feet x 4 feet. Ordinance 427.42(17)(3) requires the maximum area of a single sign to be 12 square feet per surface plus 2 square foot per surface for each one foot of setback greater than 30 feet. The current sign is approximately 4'x4'. 5. The proposed sign will be mounted on a stone base. The sign will have white letters with a dark brown background. The reader board will have a black back- ground with white letters. The sign will be internally lighted. 6. Ordinance 427.23 states that variances shall be approved only by circumstances unique to the property under consideration would cause undue hardship to owner. The applicant has stated that if the sign were to be placed as required it would defeat the purpose of the sign and interfere with future building plans. 7.
