Concept Review. March 13, 1985 Case No: 85 -12 Applicant: Rudy Luthers Hopkins Motors Inc. Location: Northeast corner of 5th & Excelsior Avenue Subject: Concept Review STAFF FINDINGS & COMMENTS: Kerrigan I. The subject site is now occupied by the Hopkins Theatre and its' related parking. The applicant is proposing to remove the existing building and replace it with his new car operation presently operating at 8th & Excel- sior. The used car operation and body shop are to remain in operation on the existing site. 2. The southerly 300' of this parcel is zoned B -3 Business with the northerly portion zoned R -1 -C Residential. An auto sales use is allowed in B -3 Dis- trict with the granting of a Conditional Use Permit. Thus the applicant would be required to have the residential portion of the parcel rezoned to B -3. In accordance with 427.36 A an auto sales lot must meet the follow- ing requirements: A. Auto sales including sales lot and major auto repair provided: P (a) the sales lot shall not be larger in square footage than the square footage of the building devoted to the realted business. (b) the 20 feet required front yard shall be landscaped and should the front yard be less than 20 feet due to non- conforming use, a permanent barrier at least 18 inches high shall separate the sales lot from-the public walk. (c). lighting of the sales lot shall be totally from indirect lighting (d) should the lot abutt an "R" district an acceptable design of screening fence 5 feet in height shall be constructed along the abutting lot line. (e) the auto sales lot shall not include vehicles over a 9000 lb. rated weight. 3. The building as proposed would be one level with approximately 22,590 sq. ft. The main orientation of the building will be to Excelsior & 5th Avenue North. The applicant is proposing to retain the existing theatre tower on the site as a structure for signage. Because of the height and possible location in the front yard setback this aspect of the plan would require a variance. 4. The entire parcel contains approximately 121,000 sq. ft. 293 parking spaces • are proposed to be provided. The existing dealership presently has a problem with parking. The applicant should be required to provide documentation that adequate off - street parking will be avilable to meet their needs. Three access points to the site are proposed along 5th Avenue North, one on Excelsior Avenue. The present curb cut on First Street North is proposed to be eliminated. . Case No: 85 -12 Page 2 5. A 20' setback area is proposed along Excelsior Avenue. Parking would be directly adjacent to the westerly property line. The applicant has stated that he will have a preliminary landscape plan prepared prior to the Concept Review. 6. One problem created by a new use of this site relates to Burger King. They presently have an agreement with the theatre to use their site for overflow parking during the noon hour. 7. Applicant has met with the neighborhood and the CCDC. u • 1. 5TH AVE.
