STAFF FINDINGS AND COMMENTS: Kerrigan
The applicant is requesting a Conditional Use PE!rmit to undertake Auto Sales and
Leasing on the subject site. In conjunction with this request the following
variances are required;
- Off- street parking. 427.43(7) requires that parking spaces shall be
yr� - unobstructed and accessible and that not more than 25% shall be 8'x16'
with the remaining 75% 9'x20'. The plan as proposed by the applicant
details all the parking spaces to be 8'x16'.
- 427.36A (a) requires that an auto sales lot shall not be larger in
square footage then the building devoted to the related business. The
subject building is approximately 6560 square feet while the related
• sales lot is approximately 20610 square feet.
i 427.42 limits the height of a sign to 35 feet. The applicant is proposing
{ to exceed this height requirement by 15 feet.

NOTE: The purpose of a variance is to provide relief to a property owner when
the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
only in unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
