Use Permit-Auto Sales and Lease• • March 18, 1985 Case No: 85 -14 Applicant: Walser Corporatio Location: 317 West Excelsior Avenue`' " -- --- -- -= Request: Conditional Use Permit for Auto Sales and Lease STAFF FINDINGS AND COMMENTS: Kerrigan 1. The subject property is zoned B -3 Business and contains approximately 27;170 sq. ft. As part of the Conditional Use Permit recently approved for the new car dealership to the south, this site was approved for storage of vehicles with the condition that no sales take place. 2. The applicant is proposing to locate the Walser Auto Leasing operation on this site. In conjunction with this use it is proposed that used autos will be sold (the applicant has stated these would be basically the older lease cars). 3. Auto sales and /or lease operations are required by 427.35 of the Hopkins Zoning Ordinance to receive approval of a Conditional Use Permit. 427.36 A requires that such a use meet the following requirements: 427.36 A. Auto sales including: sales lot and major auto repair provided: (a) the sales lot shall not be larger in square footage than,the square footage of the building devoted to the related business (b) the 20 feet required front yard shall be landscaped and should the front yard be less than 20 feet due to non - conforming use, a permanent barrier at least 18 inches high shall separate the sales lot from the public walk. (c) lighting of the sales lot shall be totally from indirect lighting (d) should the lot abutt an "R" district an acceptable design of screening fence 5 feet in height shall be constructed along the abutting lot line (e) the auto sales lot shall not include vehicles over a 9,000 lb. rated weight 4. The site is proposed to be developed in the same manner as was approved for the auto stcrage lot. 81 parking spaces are to be provided. Ordinance 427.45 requires 25 spaces. The existing 80'x82' building will be remodeled to contain approximately half offices and half showroom. 5. The entrance to the site is to be directly east of the building. Two signs are proposed to be located directly adjacent to the entrance. 6. A 10' (approximately) sodded boulevard is shown along the south property line. This planted area is separated from the parking area by a chain and post barrier. 7. The applicant has met with the neighborhood and the CCDC on the concept of this • type of use on the site. For its review, the City staff was only provided a site plan.
