STAFF FINDINGS & COMMENTS: Kerrigan
1. The Zoning Ordinance requires that an auto sales use is only permitted with
approval of a Conditional Use Permit. As part of this permit, the applicant
must meet certain requirements as specified in 427.36(a) This section states
that the sales lot shall not be larger in square footage than the square footage
of the building directed to the related business. The plan as proposed by the
applicant calls fora building size of 23,400 square feet with a total lot area
(excluding the building and landscape areas) of 76,413.
2. The zoning ordinance states that a variance shall only be granted because of
undue hardship due to circumstances peculiar and unique upon such parcel. The
applicant has stated this variance is being requested in order to facilitate
sales on the entire property.

the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
only in unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
