STAFF FINDINGS & COMMENTS: Kerrigan
1. The subject property is a single family home fronting on 5th Avenue North.
The garage is adjacent to the rear wall of the house, extending to the east.
The driveway entrance is along Second Street North.
2. The applicant is proposing to construct a 16 x 24 addition to the existing
14 x 20 garage. 427.08 (3) allows accessory buildings in an R -1 -C Residential
District to have an aggregate area of 8% of the lot area. With the addition,
the garage would have 664 square feet which would be in conformance with this
size requirement.
3. The zoning ordinance requires that attached accessory structures comply with
the setback requirements of the district. The addition would be located
25.94 feet from the rear property line, the ordinance requires 35 feet. The
vehicle entrance side of the structure will have a setback of 16 feet which
is the same as the existing structure. 427.08(4) requires a 20 foot setback.
4. The applicant has contacted his surrounding neighbors. 427.04(108) states
that a variance shall be granted to a specific parcel of property because of
undue hardship due to circumstances peculiar and unique upon such parcel.

NOTE: The purpose of a variance is to provide relief to a property owner when
the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
