STAFF FINDINGS & COMMENTS: Kerrigan
1. The - , applicant has an existing auto body repair shop located on the subject
site which is zoned B -3 Commercial. The surrounding properties are all
commercial except to the north which is single-family residential.
2. The addition as proposed is 152'x30' with a height of 14' (the existing
building is 16'). It would extend from the west wall of the existing
building.
3. 427.35 requires a rear yard setback of 10'. The minimum side yard setback,
because the property abuts a residential district, requires the same setback
as the 'R' district which, in this case, would be 8'. The applicant is re-
questing a variance to reduce the rear yard to 1' and the sideyard to 7'2 ".
4. With the addition, 6 parking spaces would be required. Four spaces are
shown on the west, 2 on the north side.
5. The applicant has contacted the adjacent neighbors and none of them have
expressed opposition. 427.04(108) states that a variance shall be granted
to a specific parcel of property because of undue hardship due to circum-
stances peculiar and unique upon such parcel.
6. If approved, the applicant will be required to comply with all requirements
of the Fire Marshal.

NOTE: The purpose of a variance is to provide relief to a property owner when
the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hard to the applicant is the crucial test. Variances will be granted
on y n unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
Hardship A.
Explain why strict enforcement of the Zoning Ordinance would cause undue
hardship:

room, however, we do not have adequate space for these. With
this small addition, we think we could opera more ec ively
and the addition would also be an improvement for the
immediate neighborhood
Conditions B.
What are the special conditions (shape of
conditions, etc. of this request that are unique property 1 q q p p y and
do not apply y generally to other properties in the district?
Because of the lot size the 16 ft tQ the rear of the
building is wasted space, used now only to dump scrap
metal. The scrap metal could h ave been stor in a
area next to the building, however, the alley extends 2z ft
on our property makes this side space unuseable. Sn
metal would be st ored between Hopkins Auto Body and Feste
Automotive if addition were to be built.
