STAFF FINDINGS & COMMENTS: Kerrigan
1. The subject property is located on the southwest corner of Highway 18 and
County Road 3. The applicant is proposing to- .erect a billboard on the
property directly adjacent to the highway, and south of the railroad
right -of -way. N
2. The sign as proposed would be a single pole, two faced, advertising sign
with a total of 246.5 square feet. The sign would be utilized by KSTP to
advertise their channel. 426.42(18)8 allows advertising signs in the I -2
districts not to exceed 250 square feet. The sign also meets all other
distance requirements for billboard as detailed in 427.42(21) of the new
sign ordinance. Interior lighting of the sign is proposed.
• 3. 427.42(14) limits the height of a sign to 35 feet. The applicant is re-

questing a height variance of 15 feet. The reason for this request is
that Highway 18 is elevated in this area and the additional height is re-
quired in order to provide adequate visibility of the sign from 18.
4. In the staff review of the new sign ordinance the subject site was one of
the few locations in the City determined to meet the requirements for
erection of a billboard. Similar requests have been reviewed by the Com-
mission for the properties directly north of County Road 3.
5. 427.04(108) states that a variance shall be granted to a specific parcel
of preoperty because of undue hardship due to circumstances peculiar and
unique upon such parcel.

NOTE: The purpose of a variance is to provide relief to a property owner when
the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
only in unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
