STAFF FINDINGS & COMMENTS: Anderson
1. The applicant is requesting sideyard variances to construct a ten unit townhouse
development at 9th Avenue South. This request is in conjunction with the Con-
ditional Use Permit at this site. The subject site is zoned R -2.
2. Ordinance 427.31 requires a sideyard of 14 feet in an R -2 district for a three
story building. The proposed buildings will have a southerly setback of r 6"
and a northerly setback of 12'. 3
3. There are currently residential homes to the north and south, an empty lot at
the west and a city park to the south.
. 4. Ordinance 423.23 states that variances shall be approved only by circumstances
unique to the property under consideration would cause undue hardship to the
owner. The applicant has stated that the soil conditions do not allow conven-
tional technique of building.

Request: Variance of 4' to reduce the sideyard requirement from 12' to 10'
in an R -2 District
STAFF FINDINGS & COMMENTS: M. Rafferty & J. Kerrigan
1. Last year the applicant was before this Commission on January 30, 1979 and
received at that time an approval on a preliminary plat which established
the proposed lot structure of Lots 1 thru 7 of Uppals Addition. At that
time Sohan Uppal was permitted to establish on Lots 1 thru 5 a width of
92 feet per lot. This dimension is 8 feet short of the minimum.requirement
of 100 feet in the R -2 District as specified on page 26 of the Hopkins
Zoning Ordinance. At that time the Commission accepted a lot structure
of 92 feet wide based on a historical agreement between the City-and the
previous owner for land usage in that area.
2. The applicant has requested a four foot sideyard variance on Lot 2 Uppals
Addition (two feet on each side) to construct a triplex with an overall
width of 72 feet on a lot 92 feet wide. Each unit in the triplex would be
24 feet wide. The applicant has already constructed a triplex with an overall
width of 68 feet (with end units at 22 feet wide) on Lot 1 Uppals Addition
which is also 92 feet wide. The applicant has stated that in his experience
in constructing the smaller end units, inferior units (to what could be con
structed) have been erected. The applicant has claimed the size of the units
as his hardship for granting a variance. It was explained that variances are
granted as a result of unique conditions of the land and not for the applicants
desire to construct a larger unit.
3. To this date the applicant has not filed a final plat for Uppals Addition and
should do so before construction of the proposed triplex.
