STAFF FINDINGS AND COMMENTS: M. Rafferty & J. Kerrigan
1. The applicant was before this Commission on January 20, 1979 and received at
that time an approval on a preliminary plat which established the proposed lot
structure of Lots 1 thru 7 Uppals Addition. At that time Sohan Uppal was per-
mitted to establish on Lots 1 thru 5 a width of 92 feet per lot. This dimension
is 8 feet short of the minimum requirement of 100 feet in the R -2 district as
specified on Page 26 of the Hopkins Zoning Ordinance. At that time the Commission
accepted a lot structure of 92 feet wide based on a historical agreement between
the City and the previous owner for land usage in that area.
2. The applicant was last before this Commission on February 25, 1980. At that time
the applicant was requesting side yard variance of four feet (two feet on each side)
on a proposed structure with a width of 72 feet, to be constructed on a lot with a
preliminary plat of 92 feet. Although the lots had a preliminary plat approval
(never finalized) the applicants structure as proposed did not meet other zoning
standards.
3. The applicants determination to construct a certain quality of unit lead him to
follow a recommendation from the commission of February 25, 1980. That recom-
mendation from the minutes of that meeting state that Mr. Uppal should replat
Lots 2 thru 4 to support the larger triplexes desired and replat 5 to support a
duplex structure.
4. The applicants proposed replatting appears to meet the goals and objectives of
the Commission of February 25, 1980.
5. Approval of the lots as platted, should only be a reflection on the size of the
lots and not on the size of any structure to be proposed. In other words, should
the applicant desire to construct a larger structure than what is permitted a
variance would be required.
