STAFF FINDINGS & COMMENTS: Anderson
1. The applicant is proposing to erect a billboard at the Milwaukee Railroad right-
of -way near County Road 18 and County Road 3.
2. The sign as proposed would be a single pole, two faced, advertising sign 10'x25'
per sign for a total area for both sides of 500 square feet, 426.42(18) 8 allows
advertising signs in the I -2 districts not to exceed 250 square feet. The sign
also meets all other distance requirements for billboard as detailed in 427.42(21)
of the .new sign ordinance.
3. 427.42(14) limits the height of a sign to 35 feet. The applicant is requesting a
height variance of 15 feet. The applicant has stated the reason for the request
- is that County Road 18 overpass is at its highest point and differs from other
properties along County Road 18 because of this factor.
4. 427.04(108) states that a variance shall be granted to a specific parcel of property
because of undue hardship due to circumstances peculiar and unique upon such parcel.
5. As of the date of this review, the applicant did not know the lessee of the adver-
tising space.
6. The previous application by Arthur Dean of FarVue Company was continued at the
June 4, 1985 City Council meeting. If this variance is approved at-the June 18
City Council meeting this billboard would require an additional variance for
distance from another billboard.

NOTE: The purpose of a variance is to provide relief to a property owner when
the strict enforecment of the Zoning Ordinance would cause an undue hard
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
only in unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
Hardship A.
Explain why strict enforcement of the Zoning Ordinance would cause undue
hardship:

which have not been allowed to be replaced causing Naegele lost exposure
and _creating a hardship for Hopkins businesses which seek such advertis
ing from Naegele within Hopkins border as well as Hopkins non - profit
cr anizations which receive free advertising from Naegele Due to nume
conditions of ordinance, almost no sites are available in Hopkins.

What are the special conditions (shape of lot, exceptional topographic
conditions, etc.) of this request that are unique to this property and
do not apply generally to other properties in the district?
It is adjacent to the Ctv Rd 18 overpass at its highest point and diffe
from other properties along Ctv Rd 18 because of this factor. Other pr op-
erties along Cty Rd 18 would generally not require a taller height for
sign visibility.
