Variance-Frontyard 611 13th Ave. S.Id 0 June 11, 1985 Case No: 85 -33 Applicant: Don LaMere Location: 611 13th Avenue South Request: Front yard variance STAFF FINDINGS & COMMENTS: Anderson 1. Applicant is requesting a front yard variance to enclose the entry /way of the existing structure located at 611 13th Avenue South. The subject property is zoned I -1. 2. In November 1962 the subject building was granted a variance for a front yard setback of 15 feet. The entry /way is in this setback by approximately 5 feet. Ordinance 427.38 requires a front yard setback of 20 feet. The subject property will have approximately a 10 foot setback. 3. The surrounding buildings have approximately the same front yard setback as the subject building. 4. Ordinance 427.23 states that variances shall be approved only by circumstances unique to the property under consideration would cause undue hardship to owner. The applicant has stated that by enclosing the entry /way would save energy and also for safety reasons, as people keep falling down in the entrance. 5. The applicant has contacted the surrounding neighbors. • FOR VARIANCE APPLICATION ONLY NOTE: The purpose of a variance is to provide relief to a property owner when the strict enforecment of the Zoning Ordinance would cause an undue hard ship to the property owner or deny reasonable use of the property. HardshiD to the applicant is the crucial test. Variances will be granted only in unusual situations which were not foreseen when the Zoning Ordin- ance was adopted. Economic situations are seldom unique and are rarely considered a valid hardship. Hardship A. Explain why strict enforcement of the Zoning Ordinance would cause undue hardship: 10 - 1 0 Conditions B.
