STAFF FINDINGS AND COMMENTS: Anderson
1. The applicant is requesting a variance to construct a garage with a vehicle
entrance of 14 feet from the property line at 22 7th Avenue North. The sub-
ject site is zoned R -4.
2. Ordinance 427.08(4) requires except as provided in Section 427.08 and 427.38
of this Ordinance, no detached accessory building in any district shall be
located closer than two (2) feet from any side or rear lot line, except that
the vehicle entrance side to such building shall be not less than 20 feet from
any such yard line. The applicant is proposing a vehicle entrance of 14 feet.
The proposed garage has the proper setbacks for the side yards.
3. The applicant is proposing to build a 22 x 24 garage. This size is in con-
formance with ordinance 427.08(3).
4. The present garage is 14 x 20 and has a vehicle entrance of 14 feet. This
garage would be removed.
5. The applicant has stated the reason for the request is that building a garage
20 feet from the rear lot line would take six feet off the back yard. Lot is
small, 34' x 132'deep, taking 6 feet for garage would greatly cut into an
already small back yard.
6. The applicant has stated he has contacted his surrounding neighbors.

the strict enforecment of the Zoning Ordinance would cause . an undue hard-
ship to the property owner or deny reasonable use of the property.
Hardship to the applicant is the crucial test. Variances will be granted
only in unusual situations which were not foreseen when the Zoning Ordin-
ance was adopted. Economic situations are seldom unique and are rarely
considered a valid hardship.
