Use Permit-Robert Mason/Don Perkl11111 October 17, 1985 Case No: 85 -50 Applicant: Robert Mason /Don Perkl Location: 917 Mainstreet Request: Conditional Use Permit STAFF FINDINGS & COMMENTS: Anderson 1. The applicant is requesting a Conditional Use Permit for construction over $75,000 as required by Ordinance 427.26(c) 2. The subject site is located at 917 Mainstreet, the former Nelson Shoe Store and the rear area of 921 Mainstreet. The site is zoned R -2. 3. The applicant is planning to remodel, demolish, and build at this site. The former Nelson Shoe Store will be remodeled both inside and out. The shoe repair store in the rear,will be demolished and an addition will be added behind Preferred Travel and the former Nelson Shoe Store. 4. 2403 square feet of new tenant space will be added with the proposed addition. A walkway will be constructed on the east side of the former Nelson Shoe Store and run the length of the building to the alley. 5. The applicant is not required to have off - street parking since the building is located in a B -2 District. 6. The applicant is proposing to have various plantings in the rear of the building. The applicant is not required to conform with the landscape ordinance since the building is located within a B -2 District. 7. The building will have a Floor Area Ratio of .88. 8. Ordinance 427.35 requires a front yard setback of 1 foot, side yards of 0 feet and a rear yard setback of 10 feet. The building conforms with the setbacks except for the rear yard setback, which the applicant has applied for a variance. 9. The Fire Marshal has the plans for the proposed construction, however no report has been received as of the date of this report. Any approval should be con- tingent upon approval by the Fire Marshal. 10. The City Engineer has not seen the drainage plans as of the date of this review. Any approval should be contingent upon approval by the City Engineer. 11. The height of the former Nelson Shoe Store will remain the same. The addition on the rear will have a height of approximately 19 feet. This conforms with ordinance 427.35. 12. The trash container will be located at the rear of the building and will be enclosed.
