1. The applicant is requesting a variance to; expand a non - conforming structure at
412 5th Avenue North, the present site of Mizpah United Church of Christ. This
request is in conjunction with the Conditional Use Permit requested at this
site.
2. The subject site is zoned R -4. Ordinance 427.33(2)(a) states, any house of
worship or church located in any 'R' District which provides space for more
than 20 persons at worship shall be located not less than 50 feet from any of
its side and rear lot lines. The northerly setback with the entrance addition
will be approximately 31 feet, without the addition 41 feet.
3. Ordinance 427.06(9) states non- conforming uses shall not be expanded beyond
the building in which said use is located at the time this Ordinance becomes
effective.
4. Ordinance 427.23(3) states that variances shall be issued in cases where strict
enforcement of the zoning ordinance would cause undue hardship because of cir-
cumstances unique to the subject property. The applicant has stated that the
additions will be to improve internal circulation.
