01-29-1985A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, January 29, 1985, at 7:30 p.m., in the Council Chambers of the City Hall. Present were Chair Eddy, members Berg, Folk, Janke, Kirscht and Milbert. Also present were City Manager Craig, City Engineer Strojan, and Community Development Director Kerrigan. Item: Item: 4 -142 Mr. Berg moved and Mr. Janke seconded a motion that the minutes of the November 27, 1984 meeting be approved and signed. Motion carried unanimously. Sign Ordinance referred back to Zoning and Planning by Council. Searcy Thompson of Naegele Sign Company thanked the Commission for allowing her to discuss the concerns of the company in regard to the proposed changes in our sign ordinance. They feel that the 100' setback to a non - residential building or an on- premise sign is too restrictive. After considerable discussion Mr. Berg moved and Mr. Folk seconded a motion recommending to the Council approval of the sign ordinance as drafted based on information from staff and that there is no reason for changes to the proposed ordinance. Motion carried unanimously. Case No: Hearing on an application by James Marvy of 41 - 12th Avenue North for a 85 -01 Concept Review to construct an addition to the existing Marvy Studio. 145 -548 Mr. Marvy reviewed expansion plans with the Commission. He stated that he Would not be ready to proceed if granted approval until the spring of 1986. Residents of the aprea spoke favorably about the present operation and also of the proposed expansion. Questions were asked about vacation of the alley, adequate access for the library, style and height of the building. Mr. McDonald asked if Mr. Marvy had been in contact with the C.C.D.C. and also if he had considered any property in the downtown area. Mr. Marvy stated that he would talk to them the next day. It was the feeling of the Commission that Mr. Marvy has an appealing operation and that the expansion would be of benefit to the area. It was suggested that he get some architectural renderings of the proposal, work on answers to some of the problems involved and then come back to the Commission. Case No: Hearing on an application by Bruce Goldstein of 312 Wilshire Walk for a 85 -02 Conditional Use Permit to construct a 10' wood fence at the south property 555 -809 line. Mr. Bruce Goldstein and Mr. Al Paulson, architect, reviewed the plans with the Commission and stated that he was not the owner of the property at the time the barrier wall was acted upon. Mr. Goldstein also presented a letter from the adjoining property owner stating their approval of the request. Mr. Folk moved and Mr. Berg seconded a motion recommending to the Council approval of the request for the Conditional Use Permit to construct a 10' redwood or cedar fence at the south property line with the 15' return to deminish to 6' because a 6' fence as allowed will not prevent visual sight from Highway 7 or block enough of the ambient road noise. Motion carried unanimously. Applicant is to submit a letter describing the color and material of the fence. Case No: Hearing on an application by Richard Ludwig for St. Therese Home, Inc., for 85 -03 a Concept Review to construct a Nursing Home and Housing for the Elderly 809 -811 at Smetana Road and Feltl Court. Mr. Milbert moved and Mr. Kirscht seconded a motion that Case No. 85 -03 be continued to the February 26, 1985 meeting as requested by the applicant. Motion carried. Zoning and Planning Commission minutes of January 29, 1985 continued. Case No: Hearing on an application by Lawrence Sign Inc. for R & W Properties for 85 -04 a Conditional Use Permit to locate a sign in a lesser setback than required 812 -814 at 502 North Blake Road. Case No: Hearing on an application by Walser Corporation for a Conditional Use Permit 85 -05 to locate a sign in a lesser setback than required at 314 West Excelsior 816 -1156 Avenue. Item: • Review of home occupations and related parking problems. The Commission reviewed the staff reports relating to the problem. Mr. Lund reported a vehicle which has been parked in the front yard and has not been tagged. He also stated to the Commission again that he is in favor of an ordinance change which would prohibit auto repair in residential districts. It was the feeling of the Commission and staff that at present it would be best to try to police the problems. Item: Mr. Janke moved and Mr. Berg seconded a motion to hold a hearing at the February 26, 1985 meeting regarding changes in the sign ordinance relative to billboards and signs, overhanging signs and fee schedule as suggested by staff. Motion carried. Commission requested staff to forward the proposed changes to the Design Committee for their review and comment prior to the hearing. Item: Letter from Doug Peterson regarding the image of Hopkins at the entrances to the City. After some review of the areas, staff was instructed to look at all the entrances of the city along with railroad, city and county property. Item: The Commission expressed their gratitude to Mr. Craig for all of his help and support in the past. Chair is to send letter of thanks, to be signed by members. Mr. Berg stepped down during the review of this request. Mr. Bruce Wahlborg of Walser explained the request to the Commission stating that the base for the sign hz.d been constructed with the applicant not being aware of the 10' setback. Mr. Folk moved and Mr. Janke seconded a motion to continue the hearing to the February 26, 1985 meeting to see if Walser can flag the sign the other direction and bring the sign into conformance.
